okay no okay uh yes yeah is it working okay there we go okay yeah so now switch to whatever
document you were going to oh okay so okay so everything is kind of mixed are you guys able
to see it oh no we we see now the calendar date go ahead all right so that was your zoning note
that's the zoning notice you put up am i correct uh no that's your application for appeal i see
this all right go ahead okay yeah so we see and i think this is the rest of the application
okay and that's for the uh city of there we go that's the first page of the application these
are like the mail out forms that was yep and that's the what it looks like i have the paper
right there that's the notice uh the continue hearing the violation i think that was the
second part of it these are the receipts for the um the mail out okay uh this is what it looks like
we did like the measuring of the garage door uh this is the license and inspection i think it was
yeah yeah and then this was mailed out this is front of the house and like right there that's
like the garage that was closed up with the walls up with the window right here yeah so that was
that used to be a garage but we closed it and put a window let me ask you this in your letter you
you listen to me in the letter that you had sent you identify this as a duplex is it a duplex
Yeah, there's a bottom and a top.
It's two floors.
There's two floors, but the first floor where this garage was is now an apartment?
No, it's just closed.
I just have used a garage.
Like you can see, I have a parking space additional to park the car.
do you have any more photos to show us
well it was just that i have just that from the other side and then this
like this is the full and after that line it's the neighbor's house
and this is the i guess the tax forms i did i sent them last night to the board counselor
uh this is the measuring again uh this is like the picture closer picture of the garage
and these are the deeds and what's behind that window what's behind that window it's just a
room like a storage room have a picture of that can we see that no I don't have a picture is there
uh no i don't have a picture is there is there is there a a kitchen on that level and a bathroom
is there
questions questions from the board
i have the same question what is behind the the window there you you say it's a storage room
are there pictures of that i don't have pictures um i can can i show you through the video
I'm sorry.
However you can show it.
I'd like to see what we're talking about.
Well, am I allowed to show it is what I'm saying.
If you guys want pictures, I can send you guys the pictures through, I guess,
like another email, or if I'm able to show it now, I can show it now.
You can show it now?
do you have pictures of the interior
wait how do I go back to the camera
let's see
can I stop sharing the screen is that okay
or yeah go ahead
okay so this is what it is
we just have like a
it's just like a storage
hold on
it's just like a storage
and that's the window
of there's nothing else on that level but that yeah this is just the garage this is the garage
area and there's just that closet yeah and that's like right there's the south side
so all so clearly all this work has already been done so yeah
any other questions on the board
just to to clarify i you had written in a couple places that this was a duplex and you said it was
two floors a duplex means two separate dwelling units or two apartments
is is this do you have two different apartments here or is this
just one house that has two different floors that are connected
it's a one house it's there like so if i um from the basement if i walk in i'm able to
enter the upstairs and downstairs from inside the house so wouldn't that be like a duplex yeah
yeah no duplex is having two separate dwelling units like two two kitchens um separate you know
separate entrances separate meters that sort of thing oh no no it's everything is the same so
like the downstairs there's a basement there's the laundry room and everything downstairs
the garage which we changed it up to you know just like a storage room because we don't use it
and then from the basement there's like an um entrance like a stairs to get to the upstairs
to the other floor and there's like three bedrooms upstairs a living room
Okay, thank you.

residential single-family zoning
I'm not sure what's happening.
The appellant's claimed hardship is self-created with the removal of the required accessory parking space.
The City Planning Commission recommends that the zoning board deny the variance.

good morning may it please the board joseph vicaro v-a-c-c-a-r-o on behalf of damian
kennelicchio the owner of the property our vice chair has a few questions sir
Good morning, counsel. Do you agree to weigh the reading of the refusal or stipulate to
his accuracy?
Have you emailed in all the required documents and exhibits that's needed to proceed with
this case five days in advance of this hearing?
It's my understanding that that was done by the client before he retained me.
Understood. Thank you, counsel. Please proceed and share your screen.
Thank you very much. I just let the record also reflect that I have Mark Georgette, the
client's consultant in on this call also. If I could start sharing my screen.
Can you see a house? Yes. Okay, fine. I want to make sure that we're in the right place. So
by way of background, this is a single family row home in South Philadelphia
that was purchased by Mr. Canelicchio in February of 2024.
This is an application to permit a third floor on this property
to increase the current living space from 1,128 square feet to 1,956 square feet.
It would also raise the height of the building to approximately 38 feet. There's zero tax balance owed on the property. The refusal was issued on May 21st of 2024. Again, this was the application for the erection of the third-story addition over the attached two-story single-family structure.
I'm going to show you the plans. It's just basically no change to the footprint. No change to the footprint of the property. The structures, the first and second floors are going to remain unchanged. The additional third floor would have the same building footprint.
Again, it's 1,128 square feet of living space currently, with a proposal of 1,956 square feet.
GEAR had met with the client in mid-August, August 13th, no opposition, and there was also a petition by the near neighbors showing support of the project.
Scrolling down, the zoning poster was put up onto the building, if I could zoom out a bit.
Here's the front of the building.
Here's another view of the front of the building, the arrows pointing on there, onto the building.
It's still currently two stories.
And here's a picture of the rear of the building.
I'd like to promote Damien Canelicchio, the owner of the property, so that he could adopt my presentation.
I'm going to promote Damien Canelicchio, the owner of the property, so that he could adopt my presentation.
Mr. Baccaro, let me ask you, should he have a rendering of what it will look like?
The only rendering at this point is the footprint showing the third floor, which is this page over here.
but there the client has not made the investment of um of showing the height but it's our
understanding that that the height would be 38 feet high approximately
but it's not set back for eight feet am i correct that's my understanding yes
if i could promote amian sure bring them on they've been allowed to speak
Damien
Sir, could you please state your name
It's spelled for the stenographer
Damien Canelicchio
D-A-M-I-O-N
Last name is Canelicchio
C-A-N-A-L-I-C-H-I-O
You swear or affirm to tell the truth
The whole truth, nothing but the truth
Yes, sir
Damien, have you heard my presentation?
Yes, I have
Is it accurate?
Yes, sir
And truthful?
Yes, sir
Would you adopt it as your own
as if you were testifying on your own.
Yes, sir.
I also have...
Mr. Vaccaro, wait a minute.
Before I open this up,
are there any other houses on the block
that have a third floor?
Damien, are there any other houses on the block
that have a third floor?
Well, of course, the street,
they have three stories
that they just built over there.
And then on the other side of the street,
maybe about two other homes
have a third floor.
so that's what actually gave me the idea
my brother lives next door and it gave me the idea
because I have my daughter having a baby
and I figured there'd be more room for
let me ask you this
are the other homes on the block
are they set back
they're not
do you have another client you want to bring
testify
yes the board has some other
technical questions I could call the consultant
Mark Georgette
so why don't you hold on to him
And if the board has technical issues, they'll talk to them.
Right.
Questions or comments from the board?
Yes, I'm trying to understand what it is that they want to do.
So this and I'm looking at this plan.
It looks confusing, so I don't kind of know what's going on.
Is the area where it says rear area, 88 square feet addition to all proposed floors.
Is this the three story addition that you're trying to do?
so it's a basic i'm sorry but it's a it's a basic third floor like just stairway going up
maybe two or three bedrooms i'm trying to get as much living space as possible like i said
i have a big family and i don't want to leave the neighborhood so i'm just it's just like
