First order of business, Bill 11 No. 050503, Bill No. 050570, Bill No. 12 050571, Bill No. 050828, Bill No. 050793 and Bill No. 050652 are being held at the request of the sponsors. Bill No. 050670, an ordinance granting permission to the Center City ERUV Corporation in order to demarcate the boundaries of a Center City eruv district, to construct and maintain a clear nylon cord and other ancillary facilities, including a maximum of ten poles along, over, and in certain public rights-of-way and City streets, and/or to 3 10/12/05 - STREETS attach such demarcation facilities to existing facilities owned by other entities authorized by other City ordinances, subject to such owner's consent; all under certain terms and conditions.

Good afternoon, Chairman and members of the committee. My name is William Mautz and I'm a Construction Engineer with the Streets Department. I'm here to offer the following testimony for Bill No. 050670. This bill grants permission to the Center City ERUV Corporation to demarcate the boundaries for an eruv district in Center City. The eruv, which will define a district to facilitate Sabbath Day practices for the Orthodox Jewish community, will encompass an approximate area boarded by Poplar Street, Washington Avenue, Columbus 4 10/12/05 - STREETS Boulevard and the Schuylkill River. The proposed eruv boundary is composed of existing physical features such as pole lines with aerial cables, street light or traffic signal poles, fences, river banks, embankments, bridge structures, retaining walls and building structures. These existing boundaries will be supplemented with new poles, lechis and connecting transparent string to facilitate conformance with Hebrew Law. The Streets Department has reviewed the proposed eruv and recommends passage of this bill.

May it please the Chairman, my name is Samuel Rappaport and I'm a member of the Bar. I represent the Center City ERUV Corporation. I have with me Rabbi Gabbai of the Mikveh Israel 5 10/12/05 - STREETS Synagogue, the oldest synagogue in Philadelphia, 1740, and Justin Miller, the President of the ERUV Corporation. We're here to answer any questions that the Councilmen may have. I just would say in passing that the entire Jewish community in Center City is united in this. Every congregation, regardless of branch, is in favor of this bill, and we've worked hard working with the neighbors and the City and the various agencies to work out something that's satisfactory to everybody.
Thank you. Let the record note that Councilman Ramos is also in attendance. If either one of you gentlemen could explain -- I know a little bit about what this is, because I had the pleasure of doing legislation for the synagogue on Lombard Street several years 6 10/12/05 - STREETS ago. My colleague to my right and I'm sure the colleagues to the left, she said, What is this? So if someone could briefly describe what an eruv is.
It permits certain Sabbath activities, which in ancient times were permitted inside walled cities. We are erecting a virtual wall. It's a legal fiction. Nobody is going to see it, but it's going to be there. But under Jewish law, in order to do this, you must have the permission of the secular government, and that's what we're here for. We can't do anything without that permission. There is an eruv in Lower Merion, there is one in the Northeast, there's one in West Philadelphia, and there's one in Overbrook Park. This is nothing new in the City of Philadelphia. I might say that under prior administrations, they thought that a proclamation by the Mayor was sufficient. The opinions have changed now, and I 7 10/12/05 - STREETS happen to agree with the new opinion, that it must be by an ordinance in Council. That's why we're here.

I'm here to offer the following testimony for Bill No. 050578. This bill grants permission to Nancy Trachtenberg, owner of Benna's Cafe, tenant of the property 1236 South 8th Street, to operate and maintain an open air sidewalk cafe on the northwest corner of South 8th and Wharton Streets adjacent to the property. Two tables to accommodate four occupants are proposed for the west footway of South 8th, leaving approximately eight feet clear footway for pedestrians. Four tables to accommodate eight occupants are proposed for the north footway of Wharton Street, leaving approximately eight feet clear footway for pedestrians. No rails will be used. The Streets Department has 9 10/12/05 - STREETS reviewed the cafe plan and has no 3 objection to the passage of the bill.

Good afternoon, Chairman and members of the committee. My name is William Mautz and I'm a Construction Engineer with the Streets Department. I'm here to offer the following testimony for Bill No. 050579. This bill grants permission to Green Street Collaborative, L.P., owner of the property 2019 to Green Street, 14 to construct, own and maintain two 15 exterior step encroachments to be built 16 in conjunction with a new four-story 17 multi-family dwelling. The concrete 18 steps, to be built on the north public 19 footway of Green Street, are 20 approximately eight feet wide and project 21 approximately ten feet onto the public 22 footway, leaving 12 feet of clear 23 unobstructed footway. The Streets Department has reviewed the construction plans for this 11 10/12/05 - STREETS project. As this encroachment does not adversely affect the public right-of-way, the Streets Department recommends passage of the bill.

This is not an administrative ordinance, but an ordinance requested by Mr. Jack Bienenfeld, Champion Development Corporation, 828 Red Lion Road, Philadelphia, PA 19115. The purpose of this ordinance 10 is to pave these new streets for the development of a single-family residential community. The ordinance is supported by the Department of Streets and is recommended to your committee for favorable action.
Good afternoon, members of City Council. Steven Pollack on behalf of Jack Bienenfeld. I'm co-counsel with Mr. Carl Primavera, who represents Mr. Bienenfeld. We have a companion piece that 18 10/12/05 - STREETS you'll hear about, because there are about five bills that are coming up. It's for the development of 69 new single-family homes, all completely attached. They will be four bedroom. Most of them will have two-car garages. It's up near the old Crown Cork & Seal up in the far Northeast section. We've signed the Park-Estates Agreements with the Ashton Civic Association, so both developers, Mr. Bienenfeld and my client, Mr. Azran, have set aside one acre of ground that will be used as park and will be put in with recreational facilities so that the neighbors will have the use of the area also. So we would hope that this development would be able to go forward. And I will incorporate this testimony for all the bills that Mr. Morelli will be discussing that deal with Meyer Place and Springhouse Lane so we don't have to repeat it. 19 10/12/05 - STREETS

Good afternoon, Mr. Chairman and members of the committee. My name is Beverly Penn. I'm legal counsel with the Philadelphia Housing Development Corporation and legal 28 10/12/05 - STREETS counsel for this particular development project, and with me is Joseph Powell, who is our architect on the development. We wanted to stress the importance of this ordinance for the forward movement of the development project. Mr. Powell, of course, can talk more in detail about how this is necessary for the design plan of the project.
My name is Joseph Powell. I'm an architect in Philadelphia serving the Philadelphia Housing Development Corporation. The reason for striking Perth is so that we can widen Franklin Street and create a boulevard, continuing the master plan that was developed many years 29 10/12/05 - STREETS ago for the Ludlow neighborhood of the City. Perth Street is a narrow 12-foot cartway. If we strike Perth, we can create larger yards for the new single-family housing units and, as I said, create the boulevard, which extends Franklin to the north -- or to the south.

Bill No. 050650, an ordinance establishing a parking regulation on Fitzwater Street, north 35 10/12/05 - STREETS side, Broad Street to 15th Street.
Good afternoon, Council. My name is Dionne Bracely (ph). I'm an Analyst 3 with the Philadelphia Parking Authority, and Bill No. 050650 was initiated by the Councilmanic District No. 2. The constituents sent in a petition to have this street regulated. It was on a trial basis, and no one had any problems with any of the regulations on this street.
