The ayes have it, and Resolution 160881 is adopted. Mr. Decker, 160885.
A resolution condemning Chestnut Hill College for seeking exemption from Stated Meeting October 13, 2016 10/13/16 - STATED - 2ND READING anti-discrimination laws in its appeal to the Commonwealth Court following a finding of probable cause of racial discrimination by the Pennsylvania Human Relations Commission, in defiance of its obligation to respect civil rights of its students and employees, and urging the College to withdraw its appeal.
Yes, Mr. President. In case there's not a roll call, I will be voting no on this resolution and the next one. Thank you.
Thank you. The Chair recognizes Councilman Taubenberger.
Yes. On this resolution I also would like to be recorded as voting no.
Okay. And the Chair recognizes Stated Meeting October 13, 2016 10/13/16 - STATED - 2ND READING Councilwoman Gym.
Thank you very much, Mr. President. I just wanted to clarify for my colleagues and thank Councilwoman Cindy Bass for her support, leadership, and continued attention to issues that govern human relations in the State of Pennsylvania. The resolution today is based primarily on the fact that Chestnut Hill College has chosen to address a finding of probable cause of racial discrimination around its treatment of African American students in its -African American students in regards to disparate treatment around disciplinary matters, and instead of seeking to contest the findings of this, the College has chosen instead to exercise a seeking of immunity from the Pennsylvania Human Relations Act entirely. And because of that, I believe that it is a matter for City Council to consider and address; that no institution, religious or Stated Meeting October 13, 2016 10/13/16 - STATED - 2ND READING otherwise, has the freedom to racially discriminate and that this appeal has the potential to impact thousands of students and employees as well as dozens of colleges all across the State of Pennsylvania. And, most importantly, I think today we heard a profound statement by Juanita Abernathy about what it means to fight for justice today and that her experiences over the last 70 years have put her in situations that are unimaginable for everybody unless you're there, and she was always there in that fight and that the fight for racial justice isn't about looking back 70 years ago when it seemed like we all should have stood up to do it. It challenges us in difficult circumstances and times today to stand up on issues that have been clearly established and those who fought for the Human Relations Act to apply equitably and broadly to all actors within the State of Pennsylvania. We're Stated Meeting October 13, 2016 10/13/16 - STATED - 2ND READING fighting for that to be relevant and powerful and meaningful today. And with that, I --
Before you call on the motion, Councilwoman Brown.
At the appropriate hour. I first should say thank you to Councilwoman Gym and Councilwoman Cindy Bass, where this institution sits, for standing up and raising their voices on this matter. I'm still amazed that even when we work nine days a week and 72 hours a day we're not able to pay close attention to so many issues that come before us. And now that I've recently learned what this is all about, the sadness for me is for an institution of higher learning who has this foundation Stated Meeting October 13, 2016 10/13/16 - STATED - 2ND READING based on religious beliefs to take this position for young people is disheartening. And so the good news is that we have a chance in this legislative body to speak up and speak out about matters like this. And if we don't advocate for young people, then who will? It's sad commentary -- I'll repeat myself -- that an institution of higher learning that has its foundations rooted in religious beliefs has taken this position. I'll be voting in favor of this matter, Mr. President.
Thank you, Councilwoman. The Chair recognizes Councilman Oh.
Thank you very much, Council President. It's a disturbing matter that the Pennsylvania Human Relations Commission has found Chestnut Hill College to be in violation. However, I'm an attorney by profession Stated Meeting October 13, 2016 10/13/16 - STATED - 2ND READING and I believe that under any circumstance, no matter what the situation, if there's an opportunity to appeal, then that is a person's or an institution's right. It applies in every situation. So I commend my colleague, Councilwoman Gym, for her efforts to continuously strive for a more just society, but I will disagree on that portion today and vote against the resolution primarily because I simply believe that at any time people can appeal. Thank you.
Thank you, Councilman. Councilwoman Gym, you want to make a motion?
Yes. And I move for the adoption of the resolution. (Duly seconded.)
It's been moved and properly seconded. Stated Meeting October 13, 2016 10/13/16 - STATED - 2ND READING All those in favor say aye. (Aye.)

A resolution calling on Congress to immediately rectify the injustice of the "1996 Immigration Laws" by restoring due process to immigration procedures, ending automatic deportation, and discontinuing mass detention, in order to uphold human rights and dignity in the United States immigration system.
The Stated Meeting October 13, 2016 10/13/16 - STATED - 2ND READING Chair recognizes Councilwoman Gym.
Thank you very much, Council President. I just wanted to make just a very, very brief statement about this. Twenty years ago in September, IRAIRA and the AVPA laws were passed that retroactively applied to individuals who may have plea bargained or who may have had other kinds of circumstances and also coincided with the rise of increasingly punitive laws around juvenile justice, mandatory sentencing, the war on drugs that basically created the framework of what Michelle Alexander has called The New Jim Crow of Mass Incarceration that defines American racism in the 21st century. We had an amazing hearing late last summer -- or late in June that talked about the consequences of these 20-year-old laws, and as this nation struggles with thinking through what immigration reform would look like, there Stated Meeting October 13, 2016 10/13/16 - STATED - 2ND READING are people all across the country, including very active individuals who helped establish Philadelphia's sanctuary city laws, that have encouraged us to look at the 1996 immigration laws as a means to -- as a pathway to start to reform the nation's immigration laws and put us on a correct path so that we are allowing for due process, that we don't just do automatic deportation and mass detention. We focus in on family values and we uphold the human rights and dignity of everybody in the U.S. And that's part of the reason behind the resolution, and we'll be pushing for immigrant justice and reform with the new presidency starting in January. And with that, I move for the adoption of the resolution. (Duly seconded.)
Thank you. It's been moved and properly seconded. All those in favor say aye. Stated Meeting October 13, 2016 10/13/16 - STATED - 2ND READING (Aye.)

And a resolution authorizing the Committee on Public Safety and Committee on Parks, Recreation and Cultural Affairs to hold joint hearings to explore how the City of Philadelphia can expand cell phone connectivity throughout Fairmount Park to ensure the safety of park visitors in the event of serious health emergencies or violent crime, introduced by Councilman Jones.
Mr. President, I just want to speak briefly about that.
So Fairmount Park is one of the largest urban parks in America. It is an asset to the City of Philadelphia. One of the concerns when we were touring the park several weeks Stated Meeting October 13, 2016 10/13/16 - STATED - 2ND READING back was there are major places within the park where you can't get cell phone service. So if you're injured or if you need assistance from the police, there are blind spots in there. We'd like to take a look at that in Parks and Rec with the permission of the Chair, Councilwoman Bass, and take a look at that from a public safety aspect. And I move for the adoption. (Duly seconded.)

Further to adopt the Master Plan for Philadelphia University; and approving various construction projects," for the purpose of reconsideration by the Council of the vote by which said bill passed Council.

This bill will be placed on the Final Passage Calendar at our next session of Council. That completes our Calendar for today. Are there any speeches on the part of the minority? And the Chair recognizes Councilman Oh. Stated Meeting October 13, 2016
Thank you, Council President. I just wanted to inform the public that we will be holding our second annual Philadelphia Veterans Day Parade, thanks in large part to you, Council President, and others. That will be held on Sunday, November the 6th. And today we have just four more days. If any organization would like to march in the parade, they have until October 17th to file their application. And, finally, happy birthday to the U.S. Navy, founded in Philadelphia in October 13th, 1775. Thank you.
Thank you, Councilman, and thank you for your continued good work for our armed services. The Chair recognizes Councilman Taubenberger.
Thank you, Council President. As Chair of the Aging Committee, I'm very proud to be Stated Meeting October 13, 2016 with AARP in regards to a briefing and lunch. It will be hosted in our Caucus Room, and I invite all my colleagues to join us. Thank you very much.
Thank you, Councilman. On the part of the majority, the Chair recognizes Councilman Jones.
Thank you, Mr. President. Good news. Our Resolution No. 160817 introduced and adopted September 29th, which is your particular interest in dealing with bandit guns in Pennsylvania's effort to block us from protecting ourselves against these proliferation of firearms in our city, the Editorial Board of the Inquirer agrees with us. And we are lockstep in opposition of this, and we thank them. Second thing that -- since we're on a roll, I'd like them to consider what's going on with Stated Meeting October 13, 2016 bill that would enable individuals from other counties to come to Philadelphia County and to be poll watchers. So somebody from Carbon County can come down here and watch the polls in your district, Mr. President. Because obviously people from Carbon County know how to run elections better than you and the City Commissioners in the City of Philadelphia. House Bill 29 -- and I'm almost of the opinion that I'm going to send Councilman Johnson and Councilwoman Parker back up there to regulate, because they're coming down here with this insanity -- is reminiscent of election suppression, ballot integrity officers who have come to Philadelphia in a threatening manner to suppress voter turnout in Philadelphia. It is further reminiscent of the Jim Crow era when they used to have poll taxes, literacy tests and the other. Stated Meeting October 13, 2016 Commonwealth of Pennsylvania 300,000 new people. I remember in one election not too long ago where they put out flyers in the inner city community saying that integrity officers would be at the poll to look to see if you paid your parking tickets and whether you had any outstanding warrants. And obviously that was an attempt to keep people from supporting their candidates in a one-person, one-vote manner. Guess what? We came out anyway. We elected President Obama, and we're going to come out again today. So I would urge people to monitor the House Bill 29 where you can go and send people, because maybe you can't find people from Philadelphia that would support a cause of yours. You need to go to Potter County to find someone of like mind to bring them down here to not just hand out flyers in front of our polls, but to go into the voting machine Stated Meeting October 13, 2016 strike-off lists and other things. And whatever damage they do, when they're done, they go back to Potter County. So it's reminiscent of someone looking for a solution but when there is no problem. We do not have a problem with voter integrity here. We run good elections. We count one person, one vote, and I think we should be allowed to do our job, Mr. President. Thank you.
Thank you, Councilman. Well said. The Chair recognizes Councilman Green.
Thank you, Council President. I just want to second the comments reflected by Councilman Taubenberger regarding AARP and the luncheon that will be provided for Councilmembers and staff. AARP will be talking about livable communities and how we can make the City of Philadelphia more Stated Meeting October 13, 2016 citizens. Secondly, I would like to thank Councilwoman Blackwell and other members of Council bringing Mrs. Abernathy here to City Council. That was a true pleasure. And she used the phrase "of South," and many of my staff know I tend to do a lot of book reading over the summer, and this summer I've been reading a book by Matthew Countryman also entitled "Up South" and making reflections on how although we are in the North, a lot of the issues and challenges that have occurred in the South happen "up South." And this week I had an opportunity to have conversations with a few people, and although we've made a lot of change in the City, in some ways we are still up South, and I'm reflecting on the recent issues that have been occurring in our Gayborhood where an owner used the N word. And although I'm still researching and getting information regarding all the circumstances and Stated Meeting October 13, 2016 and some of the events that have been brought to my attention, the use of the N word is never acceptable. Never acceptable. I'm glad that the Commission of Human Relations will be having a hearing on October 25th from 6:00 to 8:00 p.m. at Liberty Resources, and they have subpoenaed a number of the bar owners in the Gayborhood to talk about this issue and to not only talk about an incident that was on the video, but also about some incidents that have been occurring for some time. But the issue and the use of the N word is never acceptable, no matter what perspective, what ethnicity, what background. Use of discriminatory, inflammatory words are never acceptable in the City of Philadelphia, especially if we're going to call ourselves the City of Brotherly Love and Sisterly Affection. So I look forward to getting additional information regarding that Stated Meeting October 13, 2016 on October 25th so we can continue to try to live up to our high ideals of the City of Philadelphia. So thank you.
Thank you, Councilman. The Chair recognizes Councilman Domb.
Thank you, Council President. Just three quick things. One, I want to mention that you probably saw in the news, but I have been visiting a lot of the public schools, and I will say that I am amazed how great they are, despite what people say. Principals, teachers are doing an amazing job in our public schools. We don't talk about the positive of that enough and we need to. There might be 5 percent negative, but there's 95 percent positive, and these principals are amazing, Lewis Elkin and other schools, just amazing what they're doing, and we need to talk more about the positive. Stated Meeting October 13, 2016 two, yesterday was the, I guess, the holiest day of the year in the Jewish tradition, faith, and about four weeks ago my colleague Councilwoman Parker told me about Congregation Bethel. So I figured, you know, I wasn't sure where I could go to services yesterday, and I went to Congregation Bethel, and it was pretty amazing. They do an amazing job there, and I just want to congratulate all of you. Really it was an amazing service, one of the best I've ever been to, and I've been to a lot. Third, and not least, is tomorrow. I just want to make sure everybody knows about How to Make It in America, and it's not sponsored by Donald Trump, but it's How to Make It in America, Economic Empowerment. And I know, Council President, you're sponsoring this, and my Council colleague Cherelle Parker and myself will be there, and I just want to make sure everybody goes, because I think it will be a great Stated Meeting October 13, 2016 Community College tomorrow morning starting at 8:30. Thank you.
Thank you. Councilman, one correction. And thank you for clearing up How to Make It in America. I have gotten calls and people wanted to know is this any way connected with Donald Trump, right? Almost caused me to change the name. But this is hosted by the City Council of Philadelphia. It's not hosted by me. And our co-host for that event will be the Greater Philadelphia Chamber of Commerce and all of the chambers in the City of Philadelphia. Working together, we can all get this done. So, again, thank you for continuing to promote that. If anybody wants to -- I know Mr. Carter will love this -- wants to get insight, access, and success, they need to be there tomorrow at 8:30 at Community College, the Bonnell Auditorium, 16th and Callowhill, and there will be some great Stated Meeting October 13, 2016 thank all the individuals that are participating, particularly the Councilmembers that are serving as panelists. Good stuff. Thank you all very much. And with that, I will call on Councilwoman Reynolds Brown for a motion to adjourn.
Thank you, Mr. President. I move that City Council stand adjourned until Thursday, October 20th, 2016 at 10:00 a.m. (Duly seconded.)
Thank you. It's been moved and properly seconded. All those in favor? (Aye.)
