Frank Criniti, commenting on 180729. (Witness approached podium.)

Council President Clarke

Good afternoon.

Mr. Criniti

Good afternoon, President of Council and all the Councilpeople in this room over here. I, first of all, want to thank Councilman Kenyatta Johnson's office for working with me on Bill 180729 out there in the field, but Council President and, I believe it's, Greenlee -- I'm bad in pronouncing names. I apologize. But I've been retired for a year and a half down there in South Philadelphia and didn't have nothing to do, but to keep occupied, I started a thing down in my own neighborhood, illegal dumping of all the trash, construction material that's being dumped not just in South Stated Meeting May 9, 2019 Philadelphia but throughout the City. Now, mind you -- oh, by the way, I apologize. I want to thank Councilwoman Blackwell over there for giving me the 20 minutes last week in regards to the homeless people. Now, going around in South Philadelphia and Southwest Philadelphia, I turn around and ran across to a homeless kid that I was taking pictures of illegal dumping of construction companies that keep dumping in our streets. They don't care where they dump at. And I'm glad that this bill was passed or introduced or how it's -- I don't know the legal end of it, but I work out there in the streets. I don't work. I volunteer for this work. I just want all neighborhoods, all neighborhoods in Philadelphia to avoid this illegal dumping, and I hope the bill passes where the penalty becomes $300 to $1,000 for residential one bag, two bags, whatever it may be, and contractors -- and I'm the Stated Meeting May 9, 2019 one who suggested it in Councilman Kenyatta's office for that $300 to $1,000 fine for an individual that gets caught in surveillance cameras or whatever. I also wish that any contractor which was in the news the other day of two contractors who are dumping, illegal dumping, in North Philly up there, I wish they would turn around and pass a penalty of $5,000 to $10,000. So this way, we give those people kind of a sign that you're not going to dump in anybody's yard. I have three methods that I use and, that is, the first time I give them a courtesy call or send them a letter. The second will be a $300 to $1,000 fine. And the third, I'd like to ask the City to turn around all the dumpsters and just fill it up from the incinerator and turn around and bring it to their house in front of their porch, see how they like it. You could not believe what some Stated Meeting May 9, 2019 of the things I found in the trash bags or throughout the City of Philadelphia, South Philly and Southwest Philly that I cleared majority with the help of departments over here. So thank you.

Council President Clarke

Thank you for your testimony, sir. (Applause.)

Chief Clerk

Joe Danihel, commenting on 190367, 160720, and 190370. (Witness approached podium.)

Council President Clarke

Good afternoon.

Mr. Danihel

Afternoon. This is an official decree of the people in writ of mandamus quo warranto and, as such, requires immediate action and remedy. Every week, Council, Mayor, Governor, and others transfer private property to the government, probably illegally. The Thirteenth Amendment states Stated Meeting May 9, 2019 neither slavery nor involuntary servitude shall exist within the United States. Are Council, Mayor, Governor, and others unanimously institutionalizing slavery and involuntary servitude? Stripping my 42 USC 1982 property rights and theft of my constitutionally guaranteed just compensation leaves me without the fruits of my 28 years of payments. In Nazi Germany or Venezuela people have no property rights. Fortunately Franklin and others created a republic, if we can keep it. Restricted by the rule of law and requiring prosecution when officials -- look amongst yourselves -and others are plundering the people. Why hasn't the Attorney General investigated and prosecuted my numerous filings? Why hasn't the State Police, Philadelphia Police, or the Sheriff Department arrested anyone? Clearly, this RICO-style conspiracy to deny rights exists, and immediate action is required. Stated Meeting May 9, 2019 The constitutions require immediate remedy of this breach of law, breach of close, breach of fiduciary duty. Your oath of office requires you to act or face prison. 42 USC 1982, 1983, 1985, 1986, 1987; 18 USC 241, 242, 2381, 2384; PA Constitution, Article I, Sections 1 through 28; 26 PA CSA 703, 705, 708, 709, 711, 712, 713, 716, 902, and other laws listed in SCOTUS 15-8965, 14-1330, 14-4056 appear violated. I call on the federal and Commonwealth governments to perform their constitutional obligations to investigate and prosecute all involved in the theft and illegal deed transfer of my home, 1038 West Wyoming Avenue. The denial of God-given 42 USC 1982 properties rights for 25 years is egregious, extraordinary, oath-violating, and requires immediate remedy. A just government must obey the rule of law. This color of law Stated Meeting May 9, 2019 government must have its Charter to govern revoked until a constitutionally compliant government is installed. Public servants cannot refuse their sworn duty to act any more than a fireman can refuse to fight a fire. The sovereign people require oath, Constitution, and law be enforced, and jail is required for all who violate oath, Constitution, or law. I remind Council, it takes a lot of cooperation to create and allow this monumental corruption.

Council President Clarke

Thank you for your testimony. (Applause.)

Chief Clerk

Meenal Raval, commenting on 180976. (Witness approached podium.)

Council President Clarke

Good afternoon.

Ms. Raval

My name is Meenal Raval. I'm here today to speak on two bills that are on the agenda. 181063 is Stated Meeting May 9, 2019 about PGW's proposed LNG facility and 180976, which authorizes the Philadelphia Energy Authority to purchase electricity, gas, and motor fuel for the City's needs. Neither bill considers the climate crisis and the need to rapidly transition to zero and low-carbon energy sources. I refer you to Resolution 170706 when Council committed to meet or exceed the emissions reduction goals set by the Paris Climate Agreement. This is why we support the Office of Sustainability's municipal energy master plan to reduce and transition all of the City's energy needs to clean, renewable energy. To support the municipal energy master plan, we have worked with Councilmember Reynolds Brown to introduce Bill 181067 asking for public hearings to discuss this transition. This bill has been in committee since last December. Yes, 22 percent of the City's electricity will be powered by solar from Stated Meeting May 9, 2019 the Adams solar project so that we'll need to purchase less dirty electricity, but I learned this week that this contract has yet to be finalized. And, yes, our Office of Transportation and Infrastructure Systems is working to transition the City's fleet to all electric vehicles so that we'll need less motor fuel. And, yes, our Office of Sustainability is working on energy efficiency for City buildings to reduce our gas heating usage, but I sense they're understaffed to take this on at the scale required. So I ask that Council schedule hearings about the municipal energy master plan, as suggested by Bill No. 181067. I also ask that you hold Bill No. 180976 about municipal energy procurement until after this hearing about the municipal energy master plan. There can be no business as usual when Stated Meeting May 9, 2019 we're in a crisis. Alternatively we can revise Bill 180976 to include language to gradually reduce our purchase of electricity, gas, and gasoline or diesel in line with the climate goals we are committed to. I also ask that Council consider increasing the budget for the Office of Sustainability to take on the energy transition work that's needed. Thank you.

Council President Clarke

Thank you. (Applause.)

Chief Clerk

Rick Young, commenting on 190367. (Witness approached podium.)

Council President Clarke

Good afternoon.

Mr. Young

Good morning. Good afternoon. I would like to speak on Councilman Clarke and Councilman Greenlee efforts to move more of the development Stated Meeting May 9, 2019 from the PRA to the neighborhood. It's just something I would like to say on your behalf, and I would just like to read something to you. Neighborhood development should include everybody. Philadelphia is finally referred to as the City of Neighborhoods. A surge in new investment transforming communities to highly sought-after places to live, work, and play is not all a bad thing, but for the last 15 years, multi-million-dollar development projects has not been fair. Longtime residents, business people who have been committed to these neighborhood, have largely not been able to participate in the economic growth of their own community. Developments have not been diverse and inclusive and have been done by developers who do not live in these neighborhoods or look like the people in the neighborhood. I'm an African American real estate developer, a long-life citizen of Stated Meeting May 9, 2019 Philadelphia. I have started my business in my community, created entrepreneurial programs for local elementary schools. I still reside in the community that I grew up with. When I've had the opportunity to develop City land, I have made sure that it's affordable for working families. As a longtime minority business leader in West Philadelphia, I cannot outbid out-of-town multimillionaires for development opportunities in my city. My story is not unique. It is the reality of many minority developers in Philadelphia. Currently Philadelphia Land Bank and the Redevelopment Authority bundled properties together that they control and offered to the highest bidder. This may seem logical, but in fact it is painfully shortsighted and unfair when recognizing a small developer, particularly minority developers who lack the access to Stated Meeting May 9, 2019 capital. Operating in the City this way reduces the ability for small developers to build reasonable priced and affordable projects in our neighborhoods. Look around and you'll see the result. Luxury apartments are going up in every community. The average Philadelphian cannot afford -- the average Philadelphian cannot afford the smaller local developers and minority business people do not get a chance to participate in the economic development of these neighborhoods. Some City Councilmembers, Councilman Kenyatta Johnson, Councilwoman Blackwell, Councilman Curtis Jones, Council President Darrell Clarke have been largely criticized -- Councilmembers have largely been criticized for trying to include local business people, including myself, in the real estate development taking place in our communities. I applaud these efforts, Stated Meeting May 9, 2019 and it is unacceptable to me and should be unacceptable to everyone that minority developers are scolded for seeking a seat at the table with larger developers. I challenge the City of Philadelphia to use its resources to create more of a fair opportunity for small local developers to participate in the economic development in our neighborhood. I would like to see more development done by local diverse developers with a local diverse workforce. Not all the neighborhood growth in Philadelphia should go to outside developers just because they have the biggest bank accounts, and some development opportunities should be designated for local and minority developers, allowing more local development to -- allowing more local developers to participate in transforming their own community has the potential to produce more thoughtful development, Stated Meeting May 9, 2019 5/9/19 - STATED - 2ND READING lasting benefits for community, more business role models, more community participation. More development dollars stays in the community for local folks.

Mr. Young

Neighborhood development in Philadelphia should include everyone.

Council President Clarke

Thank you. Thank you, Councilman. On behalf of the majority, the Chair recognizes Councilman Jones.

Councilman Jones

Thank you, Mr. President. It is again that time of year when members of City Council, unafraid, courageous, go out on that Schuylkill River and represent this fine institution. Last year in the Dad Vail Regatta, City Council's team -- I made a bold prediction. I made a prediction that we would own last place, and I want you to know that we fulfilled that obligation and came in last place. I want to now give another prediction, that we will not have last place. Someone else can occupy that space, because we started out with good rowers, such as Henon, such as Gym, but we had great rowers, such as Green, such as Fenton representing Jannie Blackwell's Stated Meeting May 9, 2019 office, Councilwoman Bass and now Angie, who rowed in college. So we have a fighting chance to place this year, and I wanted all of us that are going to represent to don our uniforms, both past and present. Both past and present come up. If you had a part to come out on the river, stand up here for a picture with us.

Council President Clarke

Oh, my God.

Councilman Jones

Wait a minute. Representing Clarke's office, Will Carter, and Donna as well from my office. Come on up. (Pause.) (Applause.)

Councilman Jones

Mr. President, as you know, this is for a very good cause. We're out there braving the elements, but it's for urban kids to be able to have exposure to rowing and sculling in a year of a camp. Over 100 youth learned how for the first time to Stated Meeting May 9, 2019 and hopefully row their way into some scholarship, college activity, or just a passion for the sport. So come out, support us at the Dad Vail Regatta. We will not be last. We will not be last. We will not be last. Thank you.

Council President Clarke

Thank you. Thank you so much, Councilman, for that bold prediction. The Chair recognizes Councilman Green.

Councilman Green

Thank you, Council President. And I'll say this in a way that my colleagues from the rowing team would appreciate to Councilmember Jones: way 'nough. That's an inside joke for rowers.

Council President Clarke

All right. Thank you.

Councilman Green

Thank you, Council President. I just wanted to Stated Meeting May 9, 2019 Domb and also Councilwoman Brown for joining us this morning for the third annual (unintelligible) Association happy hour breakfast. We had a number of business owners from our city. They were able to attend the happy hour breakfast, which we had in Conversation Hall, and a number of them also attended our caucus session and a few actually came to our Council session today. So it was another attempt to continue to do dialogue and do outreach with businesses, especially small businesses, that are providing jobs in our city. So I just want to thank my colleagues for participating in the third annual event. Thank you.

Council President Clarke

Thank you, Councilman. The Chair recognizes Councilwoman Parker.

Councilwoman Parker

Thank Stated Meeting May 9, 2019 you, Mr. President. Mr. President, on behalf of myself, Councilmembers Green, Taubenberger, and Johnson, we want to take this opportunity to thank all members of Council for supporting the resolution that supports the City of Philadelphia's adoption of a new icon for individuals with disabilities. For the benefit of people at home, this is what the new icon looks like. And we invite all of our colleagues to join us today at 2:00 p.m. in the parking lot behind One Parkway, which is actually 1515 Arch Street. Enter off of the 16th Street side. And I just have to just state for the record that I want to thank Harry Barnum from Liberty Resources. He won't be there today and he wasn't in Council, but he has been a champion for individuals with disabilities. All of our colleagues know we are used to seeing Harry seated right here to the right. For those at home, if you watch it, you Stated Meeting May 9, 2019 week, and he's often talking to members of Council about the impact that certain policies will have on people with disabilities. And I also need to say a huge thanks to Bill Ryan, Barry Freedman, and the entire Einstein-Moss Rehab team. If it were not for you, this would not have been an issue that I was involved in. So I hope everyone can come and celebrate with us today. Thank you all.

Council President Clarke

Thank you, Councilwoman. The Chair recognizes Councilwoman Quinones-Sanchez.

Councilwoman Sanchez

Thank you. Good afternoon. I want to remind folks and thank Councilwoman Cindy Bass, who is Chair of Health and Human Services, and Councilman Squilla. At 1 o'clock we will be hosting a conversation with Joe Pyle from the Scattergood Foundation. Stated Meeting May 9, 2019 President, in this Council we've been debating the issue of poverty, deep poverty, and trauma-informed issues all across the City. The Scattergood Foundation heard that, and they put together an index by Council district that takes some critical factors into play. And if you haven't had an opportunity to meet with the Scattergood Foundation, please encourage your staff to attend the briefing at 1 o'clock in Room 576. I am told that because we're having lunch from Real Food Eatery that this would mean something to people. I guess the food is good. But on the issue of Philadelphia's children's health and well-being, the Foundation dove down on some important datasets. They looked at school quality. They looked at park and recreation access, fresh food access, SNAP utilization, and children's behavioral health services utilization. Stated Meeting May 9, 2019 receive a packet that will have their district ranking. They will get the citywide information. It will talk about race and ethnicity. It will talk about language access and a whole host of datasets that I think is hugely important as we continue to have this conversation about narrowing the gap in the City of Philadelphia. Thank you, Council President, for allowing us to have that. Room 576 at 1 o'clock.

Council President Clarke

Thank you, Councilwoman. The Chair recognizes Councilman Johnson.

Councilman Johnson

Thank you, Council President. I just want to wish all of the mothers Happy Mother's Day weekend. That's it. Thank you, Council President.

Council President Clarke

All right. Thank you. Thank you, Stated Meeting May 9, 2019 speeches, and the Chair recognizes Councilwoman Reynolds Brown for a motion to adjourn.

Councilwoman Brown

Thank you. Thank you, Mr. President. Councilman Kenyatta Johnson just took me to a place, so...

Council President Clarke

I understand.

Councilwoman Brown

I move that Council stand adjourned until Thursday, May 16th, 2019 at 10:00 a.m. (Duly seconded.)

Council President Clarke

Thank you. It's been moved and properly seconded that Council stand adjourned until Thursday, May 16th, 2019, 10:00 a.m. All those in favor say aye. (Aye.)
