This variant will not substantially or permanently harm the neighbors' use of their property
or impair any other supply air or flight to those properties.
I went to LNI and did everything they asked me to do.
They told me I just needed to get a permit.
I did the application process.
we submitted the plans and then they ended up denying the permit because accordingly
to the refusal the distance between the fronts of the property
can be shorter than the next property adjacent to me so this is the project information form
as required this is copy of the deed when as you can see i purchased the property a few months
before I started the project.
This is the transfer tax.
This hearing was scheduled back in October.
So I did get a certified tax compliance back then.
But it shows that all the taxes were paid
since the hearing has to be postponed
because I had trouble meeting with the RCO.
I did request a new one that was issued on February 15th.
It's this one.
That shows that the property is still clear of tax.
this is the inspection that was done by the architect as you can see on the inspection
they apply category one to this project meaning that the building and structure
represent low hazard to human life in the event of failures as well of all the details of
the construction like everything is detailed around the inspection the work
two inspections done, this is the second inspection, these are a copy of the plans that were submitted
to LNI when I first did the application, it's a couple of pages because we detail everything,
all the materials that were needed, as required, all the dimensions, this is part of the same
package submitted the first time uh they did a first revision on they were they asked that we
describe the properties uh the adjacent properties so as you can see on this plan both of the
properties were described as well as the dimension in the front of the property
in this plan we only did the dimension for our porch that's why uh they did uh
third revision a second revision I must say this is the new plan that was sent in the final plan
on this one the architect described the front of my property and both of the adjacent property
that's when they came to the conclusion that our the front of my house will be shorter than the
both of the adjacent property and that's the reason why he ended up being a denial
do you have any pictures of the property yes this is the nest um so this is the poster the required
poster and these are pictures before the property this is from the outside and from the inside i
just want to point this out uh because if you look at this part right here uh one of the neighbor the
neighbor to the left is a tenant she was living there she has been living there for a long time
at the RCO meeting she was complaining that the enclosure was damaging the property but as you
can see on this picture before the project you can see that the pole is damaged so if anything
you can see this part is breaking and damaging so you can see it on this one as well how this
is bent and damaged so instead of provoking the damage we actually fix it because by enclosing
the porch the walls what they do is just give me more support uh to the structure um but that has
been since fits so you can see on this one how damaged it was and you can see how it has been
fits um and this is the property now like after everything was done that's how we look
from the outside and from the inside um these are some documentation of the request when i
was trying to get in touch with the RCO meeting. They never answered until I finally got the
response, but it was too late for the meeting because the next meeting was in October, right
after the hearing. This is the letter that was mailed to the neighbors, letting them know about
This is the letters that were mailed to the neighbors, letting them know about the RCO meeting, certified mail received, as well as proof of delivery, and the receipt from the post office that the letters were sent.
the RCO meeting.
We sent about 173 letters.
The RCO meeting venue was changed just a few days before the meeting, but I did went ahead and posted a sign at the old location to let people that show up know where the new location was.
and I was allowed to make my presentation
due to that fact.
This is the result of the RCO meeting.
Eight people voted in support.
Six people were opposed.
So I got my votes there.
These are other properties
that are in the same sidewalk of my property,
in the same block,
just a few houses away from my house.
and this is the this is right across the street from my property and this is a perfect example
of why the permit was denied because they say that both property has to have the same distance
but as you can see on this one this property has an enclosed portion this one doesn't
and this is another property like right next to it that it has an enclosed porch so this
property is like kind of in the middle of two properties with enclosed porch and these properties
are on your on your block or across the street it's uh in the block across the street from my
property so this is like the property right in front my property okay uh and this is like part
of the block where you can see that pretty much most of the houses have their enclosed porch
like as you can see in the picture like most of them are house and closed plush uh somebody
actually testified at the RCO meeting
one of the neighbors and he
testified that he was witness of the
project and that
he testified that most of the property on that
area has been closed for so
it's nothing new that I'm doing and
it is according to every
other property in the
area and in the same block
so that will be my presentation
