and single please raise your virtual hand it's the one we want to hold right hillary
we want to hold this
she's coming back in as a panelist now chair
I want you to explain
We'll hear
Miss Siegel
There she is
There she is.
Hi, Ms. Siegel.
Hi Miss Siegel
Yes hello can you hear me
Yes, hello. Can you hear me?
I can. Do you have your video one?
Just a second.
There you go.
All right. Could you please state your name and spell it for the stenographer?
My name is Anne Siegel, first name A-N-N-E, and the last name S-E-A-G-A-L.
Right.
Do you swear or affirm to tell the truth, the whole truth, and nothing but the truth?
Ms. Sigel, this application is to convert an existing interior parking space.
Required accessory off-street parking space was removed.
An existing two-family detached structure.
No plan review associated with this application.
One other refusal.
One off-street accessory parking space is required per units in the RTA zoning district, whereas two spaces are required and none are proposed.
Our attorney, Hillary Emerson, wants to mention a few things to you.
Yes, good afternoon, Ms. Siegel.
So in reviewing your documents, I noticed that you were not eliminating the parking.
you were eliminating the interior parking, but now you have
surface parking spaces. And I did see you submitted something to L&I
that they did not review. And I think
really what your refusal should say is for the elimination of those parking
spaces, or basically the relocation of the parking spaces
to the driveway, and your refusal should be for having parking spaces
in the front yard, because L&I considers the driveway the front yard.
So you need a variance regardless, but I think your refusal is wrong.
So we're going to hear the case today, but I'm going to have a conversation with L&I
to see if we can get the refusal changed, and we'll probably need you to submit a request
to amend the refusal, but I will give you further instructions on that once I've had
a conversation with L&I.
But I just wanted to kind of clarify where we were at.
We're going to move forward today as scheduled.
you present the information that um you provided to the board um and i will have a conversation
with ellen i and let you know about next steps so we can make sure um you're getting approved what
you're actually seeking if the board does approve it okay does that make sense yes okay and our
board member tinnitus graham has just a few questions okay yes hi good afternoon um did you
um email all your documents uh some of them five days in advance before this hearing yes i did
Okay, and you already affirmed about the refusal with our attorney, Hilary Animas, and so you can proceed and share your screen.
Can you see?
Can you see?
Sorry.
So this was our first violation, can you see documents?
We can.
So the first is violation notice I received, it was 2021 November, I'm sorry, and it was
application
this is actual refusal
I received
next application for appeal
okay and project
information form
we have all the forms here
I'll go
sure go down and I'll tell you when you should start
so this is deed
all the documents
yeah this is the actual picture it's a real why don't you go a little bit we're having a hard time
seeing that oh like move it up move it a little bit or make it bigger okay well so why don't you
show it this is a this is my parking spot over here um 1078 for a locker road okay yeah um on
In my driveway, I can fit two parking spots, so this is showing how much street parking
in the area.
It's not congested over here, and it's enough space for parking.
This is my plants.
This is the plants, and this shows ... I'm sorry, my voice is just a little bit ... Can
Can you hear me?
you hear me?
What is the size of the existing
This is a size of the existing driveway that shows that two cars can fit on my driveway.
So this is next one, Ariel.
It shows where my property is.
And the next one is picture.
So we understand this.
at some point your garage was closed off yeah it was closed um with the wall and two windows
right right right and then you started to park in the front of it instead of the garage
yes and i all right uh-huh because the garage is small yeah so um um uh picture over the car
you posted your zoning yeah and you can see the parking that the the car actually fits and
And it's enough space for the car.
And your neighbors park two cars in front, usually two.
Yeah, we actually can fit even truck on the drive.
So this is the posters.
And I'll go faster because this is the picture of the front of my property,
which I want to put the door so I can have space for myself.
so i can easily easily access the space when after the surgery when i cannot do steps okay
and this is inside of the uh garage that was um enclosed with the wall and windows okay
yeah uh i'll try to scroll and stop me if you need me this is all the pictures
okay and this is the condition it's inside okay okay
this is uh you can see the slope uh on my driveway so yeah water from the street go
down and we had flood in the garage area like two or three times everything was bad so
So it really helps with the water, keep the water off the property.
And this is just area.
You can see how much space we have.
There is trucks parking on the streets.
We have enough outside for other people.
So it's not like really congested.
A lot of people parking the trucks over here.
And this is view from my window at night.
and how much parking space and how many cars are outside.
So, over the time, this is the cars they parked in front of my house.
So, I only have a small car, you know.
So, this was the picture, and if I understood correctly,
this is the proof of mailing, the meeting of the...
law rco happened and you saw the letter of support this is the picture can you see it yeah i can
this is the letter of support and the meeting yes it happened april 9 2025 and this is a letter from
my neighbor actual this is the only one neighbor everyone else is rental rentals so the only one
owner on my left and this is support uh letter from the owner of this property that he's okay
and he support my conversion and he do not oppose it you know he actually have older 94 years old
mom who act who cannot do the steps so it's really helpful to have this kind of conversion okay
okay i think this is all documents okay all right um so the board's going to ask you a few questions
relative to it and then we'll eventually have take some testimony if there's anybody online
but then we're going to hold the vote okay so questions from the board good afternoon um so
you took out the garage area correct yes and you're going to make are you making an apartment
there are you just using that space just to open it up a little bit uh at the moment it's a space
for my extra stuff and the treadmill because i have to i have to walk and i have to exercise
um i i do not have plan to have run thank you it's only for me
it's only for me do you have a drain at the at the bottom of the the slope right at the front of the
do you have a train at the
at the
i do have drain but sometimes it's over it's too much water and when it's really um i we had
like maybe more than food of the water in the past okay but you have a drink it's so severe
the flooding in so fast it just go down in the drain sometimes can be cloud in the past when i
was working i couldn't get to the drain and clean it in time and it's just okay okay thank you um
do you had a licensed contractor do this work for you no uh what happened four years ago my ex-husband
And he accidentally backed up in the garage door.
So he and his friends just did put the wall instead.
Garage.
So is there work that still needs to be done to it?
I heard you mentioned you wanted to put a door there.
That's what I was asking back then in 2022.
22, let me put the door for myself, entrance door.
So that means you're going to have to get a contractor to come and put the
door in because there's no door in right now, correct?
It's only windows and just simple.
And also I have to finish the, finish the wall.
You see the condition is, you know, it's, it's not finished.
Thank you.
Did you do any electricity and new plumbing in that space?
In the space, everything was like, it was the only thing we put insulation in the ceiling
because it was really cold and in the walls and put some of the boards, they put some
of the boards.
So you insulated it, you didn't have to run new electricity, so your treadmill could be
plugged in?
No, I don't have, there is no light, like, you know, there is no light, only the one
that was.
Questions from our attorney, Hillary Amberson.
No questions.
Just to reiterate, I will be in contact with you
and just let you know what's happening with the refusal.
So you don't have to do anything else.
I'll be in touch with you, okay?
Questions or comments from the virtual audience?
I see no hands, Chair.
Planning Commission.
Amy Boyd with the Planning Commission.
the comprehensive plan recommends no change to the rta1 residential two-family zoning at this
location the appellant has demonstrated that the history of flooding through the garage door
presents unique physical conditions or circumstances of the property that would
prevent it from being used in conformance of the zoning code and that the change would not
cause detrimental impacts would to neighbors the planning commission recommends that the board
grant the proposed variance for parking in the required front yard setback.
