that case is rescheduled um thank you mr chairman additionally i have another case
uh one more mi 2020 000 539 this is 2326 north park avenue okay so mi 2020 000 539
uh 2326 north park avenue you're rescheduling that yes yes mr chairman thank you very much
you have anything else no mr chairman evan thanks for calling in we appreciate it thank you
all right do we have anyone else in the virtual audience
leonard order from the city has his hand raised regarding a couple of cases
good morning council i'll be coming back in shortly mr chair
Good morning, Leonard.
Sorry.
That's okay, Leonard.
Could you please state your name and spell for this sonographer?
Leonard F. Reuter, R-E-U-T-E-R, Senior Attorney, City of Philadelphia.
right you swear or affirm to tell the truth the whole truth and nothing about the truth
Right.
Do you swear or affirm to tell the truth, the whole truth, and nothing about the truth?
i do leonard i understand you have a few cases here yeah there's a few that are uh listed as
city cases so i just wanted to address those i think i mean what's your first one well the first
one is uh appears to be um number one this is an appeal uh it's not a city of property but it was
an appeal against ellen i this is number one yes okay uh so that's mi 2025-003737
uh it was an appeal against ellen i for one bells court based upon the information i was
able to retrieve it looks like uh there was a decision to continue the case back in august
of 2019, the attorney representing the appellant
asked for the continuance, which I believe was put down as a turning movie
party. From what I gather, there has been no further
contact with the
board from the appellant, so the city would just ask that the matter be dismissed.
So MI 2025
003 737, 1 Bells Court.
I vote to dismiss proviso two-year rule waived actually Mr. Chair we are sorry for since this
is an appeal against L&I there's no two-year rule so we don't need the proviso on this one
we can just dismiss it thank you it's just dismissed just dismissed yep Michael Johns
my vote is to dismiss Cheryl Gaston my vote is to dismiss Tanetta Graham my vote is to dismiss
Ioan my vote is to dismiss what's your next one Leonard the next one is number two
uh which is yes so that's mi 2025 003 7451 dock street yes uh again this one was an appeal
against lni uh it involved the uh development project of the property that was owned by the
Sheraton the appeal was
brought against the development
by the Society Hill
Towers there had been a
decision in this case
and it even went on appeal
I'm going to just
like I said I'm going to try to
get the
exact information on it
it looks like
bear with me for just a moment
Yeah, so I think, again, it appears that this matter had been decided by the board,
but for whatever reason, I think the record in the Eclipse record says ZBA Other,
which i don't know what that is um i don't know if you have a way to just mark this as moot
uh the decision was to deny the appeal uh and then what do we not do and then the towers took
an appeal to the court to come and please i'm not sure i you know probably just one of these
things that got lost in the shuffle okay during the transition to eclipse but you want to waive
this uh i mean i are what how do we want to handle this just uh you know we'll just so because
leonard is not able to withdraw um so okay i can try to track if you want uh ms emerson i can track
down some of the court documents and email those to you if you want to at least get some documentation
into the record that would be great so we just continue it and then dispose of it that'll be
So MI-2025-003-7451 Dock Street, this case is to be rescheduled.
Anything else, Leonard?
Number five, MI-2025-003791, 1140 West Nevada Street.
This is listed as Appellant, City of Philadelphia.
I don't have any record of that.
It does show Matt Monroe as the attorney.
uh as some of you may recall matt was in private practice for a while and he now works for the city
he's in the real estate unit so it may be that the appellant like it picked up his name and and
something weird happened with the appellant i it it's just as far as i could tell it's just a
routine variance case involving a roof deck and roof access i can't imagine that the city itself
was involved in that uh but i couldn't find any any information on it uh i don't know
if anybody reached out to matt to see if he could clarify what what that was
rescheduled the story
i mean it's it's almost certainly moot there's been other permits and things issued since
the date of that appeal but um or but i you know i don't want to speak for matt i don't know if
he's aware that this is on the list it's not a city property though to the extent it implies that
it is i don't know if ian has any information
okay so mi 2025 003791 1140 nevada street case has been rescheduled
anyone else anything else leonard those are the only ones that i noticed that were
appeals against l and i or that might have been city property uh but i'm gonna hang on
this morning and if anything else comes up let's say um mr reuter i think you did have one other
matter um the south 13th street yes oh that uh yeah that was a case i hit so
I don't know what number is that
117 or something like that
do you know what the number that is
finding it
all right
it's 183
183 okay
yeah 183
so just so the record's clear
I'm speaking now as
leonard reuter formerly in private practice this was 183 mi 2025-003703 for 763 south 13th street
it's a matter i handled in private practice uh that is uh moot and uh it was resolved
uh back some years ago uh and i think the city could just the application and the appeal was
abandoned so that can be marked uh withdrawn i'll change that to withdrawn i was going to ask that
it'd be dismissed but it's clear from the record my 2025 003 703 763 south 13th street that case
has been withdrawn thank you thank you letter number 24 is going to be a dismissal am i correct
Number 24, MI 2025-003802-144-46 Roosevelt Boulevard.
That case is dismissed.
Two-year rule waived.
Michael Johns, my vote is to dismiss with proviso.
Cheryl Gaston, my vote is to dismiss with proviso.
Tanetta Graham, my vote is to dismiss with proviso.
Tywin, my vote is to dismiss with proviso.
Ryan McAdams. My vote is to dismiss with proviso.
Do we have anyone else in any of the audiences?
Yes, Chair David Orfanides.
Okay. Good morning, David.
Good morning, Mr. Chairman.
Mr. Orfanides, could you please state your name and spell for the stenographer?
Certainly.
David Orphanides, the last name is spelled O-R-P-H-A-N-I-D-E-S.
Do you swear or affirm to tell the truth, the whole truth, and nothing but the truth?
What case or cases do you have, sir?
So I have five cases involving four properties that I received notification from Ian about.
Why don't we start with, which is the first one?
Let's start with 2031 Washington Avenue, which is MI2020000065.
What number is that? 55?
Oh, I don't, yeah. Do I have the list? I don't know if I saw the list, but sorry about that.
Okay. Status?
I contacted the client right after I received the email from Ian. They didn't get back to me. I finally established contact with them two days ago. They notified me via email that they would just like to have the case withdrawn or dismissed. They don't intend to proceed at the present time.
So MI 2020-000065, 2031 Washington Avenue, the case has been withdrawn.
Um, next one, 3705-07 Spring Garden, calendar number 25579.
Next one, 3705 to 07.
What's that?
Have it?
Hold on one minute.
Oh, sure.
That case is off our list, so why don't you move on to the next case?
Okay, yeah, because I emailed you in just yesterday that you haven't noticed a decision in that.
909 North Taney, 35331.
909 North Taney, so that's MI2025, 003-887, 909 North Taney Street.
What's the status?
I have a calendar number of 35331.
So some of these, we had to do new calendar numbers because the old numbers were pre-Eclipse.
So we had to give it an Eclipse number.
To be honest with you, I went through, I remember the address.
I remember the name of the person associated with it, but I don't remember it involving
a zoning board appeal.
And we don't have, we actually don't even have any record of them being actually formally
becoming a client.
And I don't have any record of a zoning board appeal for this.
So I'm a little bit at a loss on this one.
Although, again, the name and the address sound familiar to me.
So I'm not sure what to do with it at this point.
I might ask that we look into it a little more to ascertain whether we really were representing them or not, whether they filed an appeal.
Sometimes people file appeals and just put our name on it.
I'm not sure what this one was about, but I don't have any information on it.
Thank you very much.
So MI-2025-003-887-909 North Taney Street.
Our case is rescheduled.
And then the other address involves 3824 North Broad Street.
I have two calendar numbers, one of which is the same as what Ian had sent, and one which is not.
One of the calendar numbers is 23587.
Yeah, I actually have a list of two here.
And then the other one you have is two, five, nine, four, zero.
And it's weird because then when I went through my file, the calendar number that the other
calendar number that I have is two, nine, four, eight, nine, I do see on that list that
the two numbers that Ian provided are the two numbers that show on that list, but I
have like.
So what's the status?
So the status is, is that the client, um, I have not been able to reach the client.
I've emailed them.
I've tried calling them and I don't have any information from them at this point.
And I would imagine I've driven by the site. I don't see any activity there. I've contacted the architect. They haven't heard from them in ages. So, but I don't have any affirmative direction from the client. I can continue to work on that if you would like.
