Thank you. Good morning. I note that the hour has come and that a quorum of this Council is present. To give our invocation this morning, the Chair welcomes my cousin, Father Steven Albero, the Director of Vocations at Daylesford Abbey in Paoli. He is here today as my guest. And at this time, I would ask all Members and guests to please rise. (All rise.)
Blessed are You, Lord, God of all creation. Through your goodness, you have made the universe and brought order from chaos, making our world a place of life and light. We continually turn to You for Your guidance so that we might truly live life and see the light. We ask You to enlighten the hearts and minds of all those gathered here today. Brighten the darkness that keeps us from trusting in Your GREETING/INVOCATION loving providence. Guide by Your gentle spirit the members of this Council and help them to serve the people of the City of Philadelphia. By all their efforts, show that they work together for the good of all. We are pleased today to welcome the National Academic League of the Masterman and LaBrum Schools. Councilwoman Miller will present the resolution. While we're bringing the students up -- and all the students can come up -- I just want to say that it's really a pleasure to honor our young people when they competed in the Academic League. We honor sports teams all the time and we want to make sure that our young people are also honored that have been competing and done very well in the academic part of their school life. So we want everybody to come up front. (Students come forward.) Mr. Rifkin, Mr. Rifkin, would you come on up, too, please. (Mr. Rifkin comes forward.)
Thank you, Madam President. This is a resolution honoring and commending the National Academic League. Honoring and commending the National Academic League on VISITOR RECOGNITION/PRESENTATIONS transforming participating Philadelphia District schools into teams where academic athletes are honored and student/parent/teacher collective efforts receive the attention and rewards that they so richly deserve. Further honoring all teams: in particular, LaBrum, and City Champions for the Middle League District, Masterman Middle School, for generating the same fever, enthusiasm, and pride in academics as sports teams and winning City or divisional championships.
Whereas, it is common knowledge that to successfully compete in an ever-evolving and increasingly sophisticated world, students need to be instilled with not only the desire to learn but also equipped with the ability to problem-solve, both individually and collectively, and take pride in attaining knowledge; and
Whereas, countless studies have shown that during the middle school years, ages 11 to 14, students stand at a crossroads. Factors, including lack of personal and external motivation, peer pressure VISITOR RECOGNITION/PRESENTATIONS that views excellence or the aspiration for such in academics as a negative and disproportionate sense of pride in athletics as a way to achieve success disproportionately contribute to the moral and social dilemmas that occur during this critical developmental stage; and Whereas, the National Academic League was created to address these problems as well as revitalize the passion for learning that is so essential at the critical intermediate grade level. The program has managed to combine aspects of team sports, including competitiveness, strategy, and group performance, with the mastering of individual learning, critical thinking, and scholarship; and. . .
Whereas NAL, having been developed and refined since its inception six years now includes 39 school districts nationwide representative of over 300 intermediate or junior high schools and approximately 7,000 students, the Philadelphia School District participates in the new sport wherein an academic season with four separate quarters span the subject areas of math, English, science, and social studies, with each VISITOR RECOGNITION/PRESENTATIONS quarter emphasizing different types of skills; and Whereas, 37 middle schools, 8 high schools, 39 coaches, and 39 principals within the School District of Philadelphia are National Academic League schools and have played regularly scheduled games since December 1999; and. . .
Whereas, the City championship between Masterman and LaBrum was held on Wednesday, March 1, 2000. While there are truly no losers in this enriching experience, Masterman, as champions, will compete via televideo against Pueblo schools in Pueblo, Colorado, for the national championship; Now, therefore. . .
Be it resolved by the Council of the City of Philadelphia that we hereby honor and commend the National Academic League on transforming participating Philadelphia District schools into, quote/unquote, teams, where academic athletes are honored and student/parent/ teacher collective efforts receive the attention and rewards that they so richly deserve and further honoring all participants, and in particular LaBrum and City Champions for the VISITOR RECOGNITION/PRESENTATIONS Middle League Division, Masterman Middle School, for generating same fervor, enthusiasm, and pride in academic sports teams in winning City or divisional championships. And be it further resolved that an engrossed copy of this resolution be presented to Michael A. Clayton, National Academic League Commissioner for the School District of Philadelphia, LaBrum and Masterman Schools, as evidence of the respect and sincere regard of this legislative body for their efforts in improving the educational quality and community spirit of participating schools.
Certification that this is a true and correct copy of the original resolution adopted by the Council of the City of Philadelphia on the 2nd day of March 2000, signed by Anna C. Verna, President, introduced by Donna Reed Miller, sponsored by all Members of City Council. (Applause.)
I'd just like to further add that, as noted, this resolution was introduced in March 2000, and that's when the VISITOR RECOGNITION/PRESENTATIONS Masterman School was going to compete for the national championships. And since that time, we are very proud, and we want to congratulate Masterman on winning the National Academic League Championship. (Applause.)

Good morning, Honorable Council President Verna, distinguished members of City Council, and a special thanks to Councilwoman Donna Reed Miller for bringing this wonderful occasion to the attention of City Council. My name is Michael Clayton, and I represent the School District of Philadelphia in the role of the Commissioner of the National Academic League. This is the fifth year of the School District of Philadelphia's involvement. You have before you the Philadelphia champions and VISITOR RECOGNITION/PRESENTATIONS the second-place winners, and we're very, very proud of them. But I'd just like to reiterate what Councilwoman Donna Reed Miller said: that Masterman Middle School went on to become the national champions, and that's a big thing. (Applause.)
Which means that they competed against over 300 schools in the United States and 7,000 students, and we have our national champions here. And it wasn't an easy thing; it was a very difficult thing. This is something that the whole City of Philadelphia should be very, very proud of. But in addition to that, the National Academic High School League, Masterman School, was the second-place national winner in the United States, and I think that that should be commended as well. (Applause.)
I would just like to briefly acknowledge for their presence here today and their support the principal of Masterman School Barbara Bravo (ph.) VISITOR RECOGNITION/PRESENTATIONS (Applause.)

I'd like to acknowledge Kevin Kane who is the deputy commissioner. He was not able to be here today, but we could not have done this tournament without him. (Applause.)

Again, I'd like to thank City Council for this splendid day and this splendid citation and honoring one of the many, many positive things that go on every day in the School District of Philadelphia. I understand that we're going to have a short demonstration so that you can see -- okay, very good, thank you.
We're going to do a short demonstration, you can get set up. But we also have Mr. Rifkin.
Today is a great day in the lives of the Rifkin family, the Enselberg (ph.) family, and the Horowitz family. I'm very proud that my daughter has come to such achievement in my lifetime. Thank you and good luck to everybody. (Applause.)

We're going today honor Dan Harrell, the custodian of the Palestra, who, at the age of 56 and after 10 years as a part-time student, will graduate with a bachelor's degree from the University of Pennsylvania. (Applause.)
And I've asked Councilwoman Blackwell, who is the District Councilperson for the University of Pennsylvania and Palestra to join me here today, and Councilman Nutter, who is the graduate of the University of Pennsylvania. VISITOR RECOGNITION/PRESENTATIONS Whereas, a March 19, 2000 article in the Philadelphia Inquirer dubbed Dan Harrell "the greatest Penn success story," and -- with no disrespect to Councilman Nutter; Whereas, Dan Harrell, a native and current resident of the City of Philadelphia, is revered by his peers as a Penn institution, not only because of his impressive academic achievements at the age of 56 but also because of the love he lavishes for the fabled Palestra floor and the students who play on it; and Whereas. . .
Whereas, as a University of Pennsylvania student, Dan Harrell has achieved an impressive 3.19 grade point average, with a major in American civilization. As custodian of the Palestra, he meticulously and faithfully cares for the Palestra, its locker rooms, and the entire arena hardwood floor until it sings to him with the squeak of sneakers. And as inspirational friend and supporter, Dan Harrell looks out for the athletes, scribbles notes of support, gives them rides and good luck charms, asks about their grandmothers, advises them on VISITOR RECOGNITION/PRESENTATIONS classes to take, and through his pursuit of a dream inspires, them; and. . .
Whereas upon graduating from the University of Pennsylvania, Dan Harrell plans to continue to be an integral part of the Penn and Philadelphia community, possibly continuing as custodian of the Palestra or working in Penn community relations in neighborhoods he has known since childhood, or working in sports facilities management, or working as a teacher, counselor, or mentor; and. . .
Whereas, because of his dedication, Dan Harrell is a hero to some and mentor to others and an inspiration to everyone fortunate enough to make his acquaintance. Now, therefore, resolved by the Council of the City of Philadelphia that it hereby honors Dan Harrell, custodian of the Palestra, who, at the age of 56 and after 10 years as a part-time student, will graduate this Monday with a bachelor's degree from the University of Pennsylvania. Resolved further that an engrossed copy VISITOR RECOGNITION/PRESENTATIONS of this resolution will be presented to Dan Harrell today as evidence of the sincere admiration of this legislative body. We'd like also to congratulate Regina, Dan's wife, and obviously the mascot from the University had to join along. And his family is here and have photographic responsibilities, that's why they're not here, but Debbie, a daughter, Lenora, Colleen, Jackie, Cecilia, Lindsay, grandchildren, so the whole family's here, and we want to congratulate Dan for his accomplishments. (Applause.)
I don't know what the exact protocol is. I'm going to say good morning to City Council -- thank you for having me -- and especially Anna Verna back here, the President of City Council. She came a long way, Ann. VISITOR RECOGNITION/PRESENTATIONS I want to get one thing out of the way. Ann Verna, we go way back, and every time Ann Verna seen me, I was usually complaining about something for Southwest Philly or looking for something. I have another complaint, and while I got the chance, I'm going to take it. You know, I took the trolley car down here, and my wife said, "Why are we taking the trolley?" I said, "I want to take the trolley, I got something I want to check out." So we get off, and she says, "Why we getting off at 13th Street?" And I said, "Watch and just come with me." And damn, I was right, what happened to the popcorn guy downstairs? I mean, the only reason I used to come downtown here was to get that smell from that popcorn, and the guy's gone. I don't know who's responsible for it, but get him back. Anyway, I got that off my chest and I feel better. I don't know how many folks are still here from the Masterman School, I don't know if they left or what, but things happen for a reason. If one or two of you are still here or if any of your teachers are still here, I have a lot of friends at the University of Pennsylvania, and VISITOR RECOGNITION/PRESENTATIONS I have a lot friends everywhere -- that's the reason I'm standing here. If you do get a chance before I introduce -- I can't introduce everybody here, but there's a group in the back of the room here that are members of the varsity men's and women's basketball team of the University of Pennsylvania who I consider dear friends, and that's as far as I have to go, they know how I feel about them. If you do get a chance, if you do get a chance and if you're from the Masterman School, or from any school, and you want to find out what it takes to be successful in not only athletics but in academics 'cause academics, that's first thing, I suggest you take a couple seconds and take a walk in the back of the room over there and introduce yourself to these great young ladies and great young men. At this point, I'd like to introduce everybody who came down to help me. I did a couple papers at one of my courses at Penn, and both of 'em were on Philadelphia. I'm one of those guys who just can't forget Philadelphia. (Applause.) (Mr. Harrell introduces members from VISITOR RECOGNITION/PRESENTATIONS Penn's sports teams.)
Getting back to what I was trying to say, it takes -- in both of those papers, it came up to saying -- and I'll get out of here -- it takes a whole village to raise the child, it takes a whole village to raise the child. You're looking at a 56-year-old child up here, and I had the whole village. I had the City of Philadelphia, I learned so much on the streets of Southwest Philly, as did Michael Jordan and Coach Dunphy (ph), who were fortunate enough to be from the City of Philadelphia. I owe a lot to the City of Philadelphia, I owe a lot to the professors at the University of Pennsylvania. I'd like Dr. Janet Tie (ph.) to stand up, who was one of the professors who was good enough to come out. (Applause.)
I'd like to ask Frank Dunphy to please stand up, Fran Dunphy. (Applause.)
I owe everything I have, and I heard this said at the many, many union meetings: I owe everything I have to the VISITOR RECOGNITION/PRESENTATIONS Teamsters. Teamsters local 115, they gave me a break, and my daughter Lenora in the back, I remember the day she drove us up there, and the last time Jim Smith seen me, he said -- I don't know if he remembers it, but I will ask Jim Smith to stand up. This is Jim Smith, President of the Teamsters Local 115. (Applause.)
He said, "Dan, be careful of the drinkin' and just do your job." (Laughter.)
I don't know if he remembers that, but that's what he said that to me, and I hope I'm a proud example to the Teamsters and all they represent, and I represent Penn and a marriage of Penn and what Penn does, the benefits they give to people. And I represent a lot of people. I don't represent Dan Harrell, I represent a lot of people. My family's here, my daughter Lee, my daughter Debbie I won't forget this time, my daughter Colleen. I can't see back, I hope they're all here. My son-in-law Mike, but I just could go on and on and thank so many people. VISITOR RECOGNITION/PRESENTATIONS And, you know, the other day, the other day, my wife, Regina, get up here, Jean. (Laughter.)
But I'll say a couple of things. The other day Dr. Tie -- I think Dr. Tie worries about. And me she said, "Dan, you are going to get spiffed up for this, aren't you?" And I said yes, but I wore this (putting on janitor's cap) so everybody would recognize me because I am not a Today's Man man. Now you know me, right? (Applause.)
Anyway, I have to get going. I just want to thank everybody for being here. And the other day after I got done cutting the lawn and cooking the dinner and doing the dishes, I heard the QVC lady get up there and she was giving a farewell speech, and she said, "If you love your job, you'll never do a day's work in your life." And I have to say, and everybody knows, that I love the Palestra, I love the University of Pennsylvania and Curtis Brown, Larry Lockley, I love everybody down at the Palestra, and I'm the luckiest man in the world to have the VISITOR RECOGNITION/PRESENTATIONS friends I have in this room, and I know I'm going on a little too long, but I can't say --.
You know what, touche now. You ready for this? Good Morning America's supposed to come down and watch me on graduation day, and I never watch Good Morning America. So, anyway, I said let me watch this so I know who I'm talking to. So last week, there was two people up there and they had signs and they misspelled them. You know, there was the weather guy, and I knew what the problem was: those two people went to Princeton. (Laughter.)

On this day in which we're honoring educational achievement, it's particularly fitting that this resolution be presented, a resolution honoring Doreen S. Davis as the Philadelphia Bar Association's first Chancellor of the 21st Century. Whereas, Doreen S. Davis graduated from Temple University School of Law in 1978, magna cum laude; and Whereas, Doreen S. Davis started her distinguished career as a field attorney with the National League of Relations Board and later joined Montgomery, McCracken, Walker and Rhoads, where she is now a partner and chairs the firm's Labor and Employment Law Department; and Whereas, Doreen Davis is widely known for her successful nationwide labor and employment practice, working on the National Labor Board VISITOR RECOGNITION/PRESENTATIONS Union negotiations and employment litigation; and Whereas, Doreen Davis has served pro bono as Chair of the Lawyer for Every Child Energy Appeal for Disabled Children and on the boards of the homeless and volunteers for the indigent program; and Whereas, Doreen Davis is the first working mother to ever become Chancellor of the Philadelphia Bar Association and has demonstrated outstanding leadership abilities and deep social concerns of the least fortunate in society Therefore, the Council of the City of Philadelphia hereby congratulates Doreen S. Davis upon becoming the 73rd Chancellor of the Philadelphia Bar Association and extends our warm wishes for a successful year of achievement. Thank you. And thank you for this wonderful recognition, but I accept it not on behalf of myself but on behalf of the 13,000 members of the Philadelphia Bar Association. These Philadelphia lawyers who, year after year, provide millions of dollars in free legal services to the poor, who are very active in the City schools and going out and teaching our young children about the legal system, the justice system, and encouraging them to consider careers in the law, and these lawyers who employ thousands of employees here in the City and are large contributors to the tax base of the City of Philadelphia. It's on their behalf that I accept this recognition. I pledge the support of the Philadelphia lawyers and the Philadelphia Bar VISITOR RECOGNITION/PRESENTATIONS Association to the City Council and the Mayor's efforts to make the City of Philadelphia an even better place to live and work. And an ordinance amending Title 22 of the Philadelphia County, entitled "Public Employees Retirement Code," by making certain corrections to address problems in the Code due to address typographical errors. And an ordinance approving the third lease agreement between the Gas Works and the Philadelphia Facilities Management Corporation, soley in its capacity as operator and manager of COMMUNICATIONS the City-owned Philadelphia Gas Works, and the Philadelphia Regional Port Authority for premises known as PPW, Lot No. 1, located near the intersection of Delaware Avenue and Tioga Street. And an ordinance authorizing the Commissioner of Public Property, on behalf of the City of Philadelphia, to enter into a sublease agreement with the Philadelphia Authority for Industrial Development for the use by the City and affiliated agencies of office space located at 1401 Arch Street. And an ordinance amending Section 10-1001 of the Philadelphia Code, entitled "Fees of Commissioner of Records" of the Philadelphia County.
