Good morning, everyone. We're going to get started. We have established our quorum, so we are going to start our Council session. The hour has come, and as we come to order, I would like to ask for an opportunity to have some spiritual advice. So to give our invocation the this morning, the Chair recognizes the Reverend Dr. Jesse Wendell Mapson, Jr., of the Monumental Baptist Church. He is here today as the guest of Councilman Thomas. I would ask all members, guests, and visitors please rise. (Councilmembers, guests, and visitors rise.)

Let us pray. Oh, God, creator of the universe and giver of life, we thank you for the gift of another autumn day with its brilliant splashes of color. Stated Meeting 3 11/02/2023 fearful days in which we live, when tensions are high, emotions are raw, and voices are angry and loud and when so many have lost faith in our cherished institutions and the ability of government to work, give each of us an inner peace that can conquer the turmoil around us. May we lower the volume of our own voices so we can hear others. May we listen more than we speak. May we dare to move beyond the comfort zones of our prejudices and biases, recognizing that we are not each other's enemy because we disagree, we're each other's enemies when we refuse to enter each other's humanity. We pray for war-torn lands across the seas, for people who are enduring unimaginable suffering on both sides. May we understand that your love, oh, God, extends to all people regardless of geographical, national, ethnic, and gender boundaries. In our own city and cities Stated Meeting 4 11/02/2023 nation, we pray for mothers and fathers who cradle their children in their arms on our streets stained with human blood. May we work to make this great city even greater, but a greatness not defined by its majestic skyline reaching into the heavens or its impressive educational institutions or its major sports venues or its glowing history, but great because of its compassion for the poor, the battered and bruised of society, and the people Jesus called the least of these. Give wisdom and knowledge to those who gather in this impressive ornate room, those who have been given the authority to exercise power and to make decisions on behalf of the people. May they use their power with wisdom and knowledge. May they govern with justice and mercy, for we know that our problems, which are many, will not be solved with laws and programs alone, as important as they may be, but with a shared vision of Stated Meeting 5 11/02/2023 live in community with one another, when each of us sees others as your children and a part of your divine creation, for you and you alone have the power to change the hearts of those who earnestly seek your face. We reject tribalism and "me first" attitudes. We denounce separatism and artificial divisions that keep us apart and hinder us from being the beloved community you desire for all humankind. May this governing body seek to do what is right rather than what is expedient, what is just rather than what is convenient and popular. We thank them for a willingness to serve and to sacrifice for the good of this city and its people. Give each of these Councilpersons the mental toughness, the physical stamina, the patience, the will to serve, knowing that it is only through you that we live, move, and have our Stated Meeting 6 11/02/2023 as Election Day approaches, may we appreciate as never before our cherished democracy and protect it from those who would destroy it in order to have their way. Good morning, Council President. Good morning, colleagues. I just wanted to take a moment to offer a few remarks about my legislation dealing with the nightlife economy as well as our Champion of the Stated Meeting 17 11/02/2023 Week. First and foremost, our Champion of the Week is Maria Mendez. Maria is a life long resident of the South Philadelphia area. Shout-out to Councilman Johnson, Councilman Squilla. She is a graduate of String Theory Performing Arts School. In 2016, Maria joined the Juntos organization and she dedicated her time to expanding access to rights and resources for migrants from Central and South America. She has done a number of different things as it relates to getting the vote out as well as being a leader in her neighborhood and community. And I would like to take a moment to welcome her to City Council, to ask her to stand as well as her parents. I know they're very proud of her as she's doing amazing work in the South Philadelphia area of the City. Maria, can you stand for us, please, so we can recognize you. Thank you, Council President. As it relates to the legislation that was introduced today, myself and Councilmember Gilmore Richardson a while back were Chair of the Arts and Culture Task Force, and out of that Arts and Culture Task Force there was a position that was created called the Nighttime Economy Director. Based on the work that's been done by the Commerce Department as well as the Nighttime Economy Director, Raheem Manning, we've found some issues as it relates to different initiatives that folks want to have at night. There's a difference between nightclubs and private clubs and other different types of entertainment venues, and we're evolving as it relates to what entertainment looks like. So this Stated Meeting 19 11/02/2023 legislation is looking to put us in a position to be able to define exactly what type of venues we have in the evening, right? We have a lot of restaurants that want to have deejays and have events, and those restaurants aren't necessarily a nightclub. So this bill is going to put us in a position to change the classification in zoning ordinances around different establishments that serve food and offer other levels of entertainment to hopefully try to give them more flexibility. We know that our Governor recently passed legislation to help -I'm sorry; had an Executive Order to help address issues related to businesses and different measures to offer more economic relief so we can provide more support as it relates to businesses. We're looking to do the same as it relates to the nighttime economy. There's a lot of questions around the legislation. We'll be sure to Stated Meeting 20 11/02/2023 have a number of community meetings as well as town halls outside of the actual hearing where the bill will be introduced. So I want to say thank you to the Councilmembers who co-sponsored the legislation and thank you to the Commerce Department and the Nighttime Economy Director for collaborating with my office to make this a reality. There's been a number of conversations as it relates to Black-led institutions and academic spaces here in the City of Philadelphia, and a lot of us know that there was a report that was released recently, over 150 pages, that talked about what took place as it relates to past behavior, specifically through the School District as well as the School Board. The goal of this resolution is Stated Meeting 22 11/02/2023 to have an in-depth conversation where we examine the findings of that particular study and try to put ourself in a position to look at what we've done wrong and explore what we need to do better in the future. So that hearing is going to be next month. I believe the date is December 6th, and we're inviting the public as well as other stakeholders to be a part of the conversation so we can explore what direction we go in as a city moving forward. Thank you so much, Mr. President. Just for the record, Member Thomas is co-sponsoring on all of those sports-related resolutions, because he is Stated Meeting 28 11/02/2023 the resident Councilperson on sports. But to windshield barnacles, a phenomena in my district and in other parts of Philadelphia has popped up and it's these windshield barnacles, which we gave the illustration to members of Council. My concern about them is that they are, A, unauthorized by the City of Philadelphia or the Parking Authority; that, B, they have excessive amounts of fees associated to get your car remobilized and the windshield barnacles removed; and, No. 3, and as important, is public safety, because for whatever invention that we have to prevent certain activities, someone will cleverly try to work their way around it. Some individuals have tried to ride off with these windshield barnacles and peeping through the side, which poses a hazard not only to the driver but to those people driving on the streets near them. So we want to take a look at Stated Meeting 29 11/02/2023 this and take a posture that it might be a good idea, it might not be a good idea, but we darn sure need to talk about it before people just take it upon themselves to start implementing technology with such dangerous implications. Thank you, Mr. President.

Councilwoman Brooks offers a privileged resolution congratulating and recognizing Youth Empowerment for Advancement Hangout for the grand opening of their Neighborhood Food Market in West Philadelphia and for their transformative work with Philadelphia's youth.

Thank you, Council President. Today I'm introducing a resolution to honor YEAH Philly, a Black-led non-profit organization that has been a champion for our young people, both on the ground and in the halls of power, since its founding in 2018. Many of us see the connection between the lack of opportunities for our young people and our current gun violence crisis, but very few organizations are as Stated Meeting 34 11/02/2023 deeply and directly connected to the needs and challenges of Philly's young people as YEAH Philly. By consistently showing up for young people, especially those labeled as having violent histories, YEAH Philly has earned the trust that is absolutely essential for changing young people's lives. YEAH Philly was started when Kendra Van de Water and James Aye saw a need for stronger support for youth and started running workshops in rec centers. The organization now owns its own West Philadelphia row home and provides over 500 youth per year a safe, authentic hangout space. They also recently opened the first free grocery store in Philadelphia, the Neighborhood Food Market, which is run entirely by teens and young adults, members of YEAH Philly. In addition to providing safe space, free food, and critical employment skills for young people, YEAH Philly also Stated Meeting 35 11/02/2023 brings young people to the center of policy decisions that impact their lives. Working with legislators in Harrisburg, YEAH Philly organizes "change the rules" to make it easier for young people to get access to their birth certificates and other legal documents that -- and they continue to advocate for much-needed changes to a juvenile justice system that has failed too many of our Black young people. YEAH Philly expertly knits together practical youth opportunities with the needs of their neighborhoods and creates programs that engage youth in ways that make them feel heard, loved, and empowered to make a difference in their own lives and in the world. Their work is a model for the kind of deep investments in young people that we need in every corner of our city. So please join me today in commending and congratulating the founders of YEAH Philly, Kendra Van de Stated Meeting 36 11/02/2023 Water and James Aye, who are with us today. (Applause.)

Thank you, Council President. I wanted to add my thanks and congratulations to YEAH Philly and specifically to Kendra and James for the work that they do. I'm so proud to have them in my district. We talk a lot about engaging young people, but I don't know of any advocates -- there aren't many advocates as credible as they are. The young people that we're talking about helping, keeping out of the path of violence, Stated Meeting 37 11/02/2023 those young people are engaging with YEAH Philly, and I just really appreciate the authenticity with which they carry out their work and their important role in our city. So thank you so much.

I want to speak on two of my resolutions. First, the resolution for our City Solicitor. In February 2021, this body proudly confirmed Diana Cortes to become Stated Meeting 39 11/02/2023 the first Latina City Solicitor in our city's more than 300-year history. Since then, Solicitor Cortes has fought tirelessly for the City of Philadelphia and its residents. She combatted gun violence through litigation, suing ghost gun manufacturers and challenging unjust and paralyzing state preemption, and she won over $200 million -- let me call and say that again -- $200 million for Philadelphians in a settlement against opioid manufacturers perpetuating addiction. Solicitor Cortes also played a core role in settling IBID's lawsuit against me over the University City Townhomes. Together, we won a historic three and a half million dollars for the former tenants and received 20 percent of the existing townhome site, where the City will construct a permanent deeply affordable housing development and green space. Stated Meeting 40 11/02/2023 This historic win was no small feat. I once calculated that my team spent 1,000 hours collectively on this lawsuit, and I'm sure that the Law Department would come up with a similar statistic if they did the math. I just want to pause here and editorialize a bit. When I started in Council, I heard this myth that like the Law Department and the Solicitor work for the Mayor, right, and they can't -they're not going to really fight for Council because the Mayor sort of writes their checks, and for me, that was dispelled when I saw Diana and her team fight so hard for the tenants of the University City Townhomes. They were up against some of the highest paid lawyers in this city, and they kicked butt. And the thing that I will never forget and I'll always be grateful for is that I felt like Diana put her whole heart into, you know, winning that lawsuit and into getting a Stated Meeting 41 11/02/2023 just settlement for my constituents, and I'm always going to be appreciative of her for that. Next Friday will be Solicitor Cortes's final day with the City of Philadelphia. Solicitor Cortes, we are very sorry to see you go, but we wish you all the best in your future endeavors, and thank you for your years of pioneering and dutiful service to the City of Philadelphia. Please stand up so we can acknowledge you. (Standing ovation.)

Next I'd like to speak on my other resolution. I'm sorry. Okay. So I talk a lot in this Stated Meeting 42 11/02/2023 Chamber about Philadelphia's world-class life sciences industry, and one of our City's earliest pioneers in this space is the Monell Chemical Senses Center. For 55 years, the Monell Center has been the world's only independent non-profit scientific institute dedicated to interdisciplinary research based on the senses of taste and smell. I'll admit that when I first heard about the Monell Center's work, I was perplexed, because we don't usually think of taste and smell as indicators of serious illness, but COVID turned this right on its head, because losing taste and smell became the first major indicators that someone was sick with the Coronavirus. For more than a half a century, Monell has blazed the path by encouraging public health officials to adopt smell and taste testing as a health monitoring and preventative tool. It is because of the Monell Center that the National Stated Meeting 43 11/02/2023 Institutes of Health describe a future where medical providers use routine smell testing to identify patients more likely to develop neurodegenerative disorders. The Monell Center is much more than an advocate. They developed a rapid smell test that makes routine smell screening acceptable and affordable to all. In this upcoming weekend, they'll be hosting the first-ever conference on smell and taste testing right here in Philadelphia. This summer I had the pleasure of attending the capstone for Monell's science apprenticeship program, which exposes young people to the life sciences and connects them to leaders in the space. Life sciences companies are flooding into our communities, and with billions of dollars worth of development going up all around us, this trend is not slowing down any time soon. We have the opportunity right now to lift residents Stated Meeting 44 11/02/2023 out of poverty and into prosperity by ensuring Philadelphians obtain the high-paying jobs that these companies promise to generate in the next several years. But we know that minorities are significantly underrepresented in STEM. Only nine percent of STEM employees are Black, and only eight percent are Hispanic. And so it's on all of us to ensure residents of color have the skills and opportunities they need to obtain lucrative life sciences jobs, and this starts by creating pathways like Monell's science apprenticeship program for young people who want to be involved with the cutting edge of science and medicine. I'm proud to represent organizations like the Monell Center that have answered the call and dedicated themselves to uplifting Philadelphia. Thank you, Council President. I hadn't planned on making remarks, but I just wanted to take a moment to congratulate our outgoing City Solicitor. Councilmember Gauthier said a lot of the demographic information as far as her making history, but just on a personal level, I really appreciated working with Solicitor Cortes. Two quick stories. The first one, Council President, as you know, when we went through the lawsuit with the School District of Philadelphia, which I still don't understand, but I'm glad it's Stated Meeting 46 11/02/2023 settled, and her ability to help navigate that confusing process and put us in a position to rectify a problem that we all know exists as it relates to our facilities, she was absolutely amazing throughout the course of that process, and I appreciate her as the Education Chair for navigating that. And of course what she did with driving equality. We went through a lot with the driving equality legislation from the time it was introduced to the time it was passed to a number of different lawsuits that we went through, and Solicitor Cortes was flat-out amazing. I'm going to miss her. I'm super sad that she's leaving, but I'm happy for her and her family that she's able to transition into a space where she can continue to show her amazing ability and great talent. So I don't do this often, but for Solicitor Cortes, I did want to just Stated Meeting 47 11/02/2023 take a moment to offer her a few brief remarks but, more importantly, thank her for her service to the City of Philadelphia. If I can look back on my time and make the change that she's made, then I know that our time in government was worth it. So thank you, Solicitor. Congratulations to you and your family, and you will definitely be missed by this body.

I want to reflect on a couple of cases, one of which you asked me, Stated Meeting 48 11/02/2023 Mr. President, to represent City Council on lost and stolen guns, and her and her team advised us on the fact that it was not probable that we would win, but it was definite that we would fight. Because sometimes it's not all about winning. It's about standing up to the bully on the schoolyard to let them know that you're just not going to -- it's not sweet, as they would say. Second one is, they fought for us, the City of Philadelphia, about bandit gambling machines that proliferate in our district, put together a solid legal team, and it's not here that they had to travel, they had to go up to Harrisburg. And there's a whole different type of -- I mean folk up there that don't see Philadelphia as a part of the Commonwealth of Pennsylvania, and her team and her, again, stood strong for this city, and I will truly forever be grateful, and you will be truly missed by the City of Philadelphia. I don't see my colleague Councilman Thomas right this second, but I did want to just make sure that he was in the loop on Martin Luther King and the outstanding achievement by our football team. And so we say congratulations and kudos to them, to those hard-working young folks for this accomplishment. I also wanted to speak very briefly on the bill that we introduced today. And just to give a little bit of a history, pre-pandemic we introduced a resolution calling on traffic calming -a discussion around traffic calming related to exactly what we could do Stated Meeting 54 11/02/2023 around areas where particularly vulnerable citizens were congregating, whether they were schools or daycares and the like, and I know that Councilman Phillips did a fantastic job last year by introducing a bill which provided speed bumps particularly around school and made them a priority. Today we're following up on that by looking out for another group of constituents who might be vulnerable in this light, and that will be our senior facilities, so our senior centers, our senior housing complexes, because we want to make sure that they are safe as well. You know, it's funny, pre-pandemic people were driving a little bit crazy in Philadelphia. You know, post-pandemic, people are driving even more crazier. It's hard to believe you didn't believe that it could get any worse, but right now we really need to slow traffic down. And so I'm really honored to be able to have support of all Stated Meeting 55 11/02/2023 of my colleagues in bringing this bill forward. So thank you, Mr. President.

Good morning. My name is Patrice Hubert. I'm a second-year post-doc at Monell Chemical Senses Center, and I'm here in support of Stated Meeting 60 11/02/2023 Councilmember Jamie Gauthier's taste and smell testing resolution. My daughter and I relocated from Connecticut to Philadelphia so I can do this fellowship at the Monell Center. I was recruited to apply and encouraged by my mentors in Connecticut to pursue this opportunity, and from my experience thus far, I would say Monell does an excellent job at recruiting top scientists to the Philadelphia area in advance of their knowledge in the taste and smell field. So when I came to Monell, my focus was on the role of taste and human nutrition. My background is a nutritional scientist and health promotion, with a focus on behavior change. So I was interested in learning more about taste and why we choose what we eat as applied to taste and smell to help guide people to healthier eating behaviors. Since coming here and studying Stated Meeting 61 11/02/2023 with other mentors, I've become more interested in understanding the inequities that are in healthcare and limited representation of diverse communities in biomedical research. Therefore, my research has taken a pivot and to bridging my background in nutrition and community health and applying them (unintelligible) that we use to recruit target populations and to health behavior studies to clinical taste and smell studies. I am honored here to support the resolution put forward by Councilmember Jamie Gauthier declaring November as Smell and Taste Testing Month. My mentor, Dr. Reed, was one of the leads on the project to develop SCENTinel, a rapid smell test. Rapid smell tests, or SCENTinel, make it possible for doctors to offer this intervention to improve our mental health, nutritional health, and our brain health and play a role in improving Stated Meeting 62 11/02/2023 health inequities. Good morning.

My name is Danielle Reed and I'm a scientist at the Monell Center, and Councilwoman Gauthier told us about the importance of smell and the special place of Philadelphia, and I'd like to illustrate that with a story, a Stated Meeting 63 11/02/2023 personal story. So I'm a scientist and I came to Monell when I was very young, and I met another scientist and we fell in love and got married and had children, and he would always help me with my smell and taste tests. Except about ten years ago, he no longer could help me, because I was giving him a rose odor to smell and he literally couldn't smell the roses, and I didn't know why at that time he lost his sense of smell, but we now know that the loss of taste and smell is one of the very first symptoms of Parkinson's disease. And so I didn't understand at the time what was happening, but this last year my husband was diagnosed with Parkinson's disease. So you may be wondering and I'm wondering if he had gotten a taste and smell test at the doctor's office ten years ago and the doctor had understood what was happening and could have made a diagnosis of Parkinson's, that he would Stated Meeting 64 11/02/2023 have benefited from ten years of early treatment. And so I'd just like to offer my personal story as an illustration to the point that Councilwoman Gauthier made about the importance of taste and smell in health. So I appreciate your attention, and I thank you.

Good morning. My name is George Gordon and I am here to oppose the Bill 230630. I'm a proud fourth-generation resident and became a homeowner in the Stated Meeting 65 11/02/2023 Strawberry Mansion area of the 2400 block of 29th Street in 1981. I am a block captain of the 2400 block of 29th Street and I am a Steering Committee Chair on the Strawberry Mansion Neighborhood and Homeowners Association. I am asking as an individual whose property is also on the list on behalf of the Association that we be given adequate opportunity to be fully informed, have opportunity to ask questions, decode the legal language of the bill and with a legal expert, and meet with community members at a time which is reasonably for most working-class residents, as the afternoon City Hall hearing and community meeting disadvantage residents from being able to fully participate. I have maintained my property value integrity in the community as a resident and not as a developer. I understand the financial responsibility and pride that homeowners bring to the Stated Meeting 66 11/02/2023 Black community, inner city community, and potential for generational wealth. My personal concern here today is in regards to the Bill 230630. My property also is at 29th -- 2429 North 29th Street and listed as a part of the Strawberry Mansion project detailed in that bill.

Just wrap it up.

Okay. So what I'm saying, in essence, is that we need to be able to understand the language and have experts along with us to help us decode the language of the bill.

Hello. My name is Ben Smith and I'm the Executive Director at the Monell Chemical Senses Center, which we heard is a non-profit biomedical research center focused on advancing our knowledge around smell and taste. Like Patrice, I did my post-doc at Monell, albeit some 20 years ago, and I left Philadelphia but came back just a few months ago to rejoin Monell and rejoin this fantastic city, a place where a lot of interesting science is being done, a place where we are actually doing a lot of work to train new scientists, as we heard from Councilmember Gauthier. And this is one of the things that's fantastic about Monell, is that we are putting a lot of effort into bringing training to underrepresented people in the STEM sciences and particularly here in Philadelphia. Now, many of you may not be that aware of our chemical senses, taste Stated Meeting 68 11/02/2023 and smell, but you've heard from stories like Danni Reed and from Patrice about the impact, and we all have seen the impact of loss of smell and taste from the recent COVID pandemic. Understanding more about our senses of smell, how we can actually monitor for these issues, is an extremely important focus that we have at Monell to try and actually help improve the public health of our community. Here's what we know about COVID and smell loss: 50 million people have lost their taste and smell as a result of COVID, up to 18 million more through other forms of smell and taste loss. So by developing these types of tests to help us monitor, diagnose, and look at potential smell and taste loss in the environment and community, we now have a way to actually help it. I support this bill 100 percent because I know this community back and forth. People need housing, but some people can't afford to buy a house. So when the bill came up, it says not only are we going to have affordable housing to buy, we're going to have affordable housing to rent. That way it covers every span in that community and nobody is left out. Ward leader from the 28th Ward. I'm here to support the resolution introduced by Council President Clarke, 230630. You know, Philadelphia remains one of the poorest cities in the country, you know, and we have seen this community where this resolution is being proposed to have housing that's diminished over the years. We grew up in a community, was full of houses and businesses, and through the crack epidemic, it devastated Stated Meeting 74 11/02/2023 our community. So this is our chance to actually re-establish our community. You know, another thing I want to just say, can you buy a house making $25,000 a year? $25,000 a year, that constitutes like $15 an hour, right? So if somebody is working at Lowe's, Home Depot or any of the other places making $15 an hour, we have to provide a way, because the families that we grew up in my generation, we had blue-collar workers working for the City, the state or corporate entities, making like substantial -- a good amount of money when the housing -- bought a house and they raised their family. We have to provide a way for this generation under us to be able to afford a house. Now, what is subsidized housing? Subsidized housing is a government-sponsored economic assistant aimed at alleviating housing costs, and of course it takes planning to be able to Stated Meeting 75 11/02/2023 buy a house, but with this resolution, the City has done a lot of planning for the constituents, right? So it takes out, you know, all the complications of you have to make 90,000, 100,000 to be able to afford a subsidized house that you can purchase, right? Then along with the bill, it comes apartments, right? So people that maybe not want to own a house or buy a house or can't buy the house, it's going to be apartments available in this community. These blocks are blighted. They've been blighted for the last 30 years. We've seen these blocks where all the houses was on this block. Now they're dilapidated through the time, through attrition maybe or just like, you know, through the chemical -- the crack epidemic, right? So the houses is not there now. So we have to provide a way, and be sensible, right, to provide Stated Meeting 76 11/02/2023 housing, because we cannot keep fighting affordable housing. So when people say, well, we don't want PHA, well, then you're saying we don't want people that's having financial challenges to have a home. When we say, well, we need to see a plan, this plan been going on for the last six years. People have been notified, you know, if they responded or not, but the notices have been put out there, right? And I don't want to disenfranchise any of my constituency in my ward, right, but this housing that I support and I'm hoping that you come around to supporting know that this is for people that's making median income, $15 or less a year -- $15 or less an hour to provide a place they can live in and stay in their community without being disenfranchised. Good morning. My name is Yasmeen Kenya. I'm a resident in the Third Council District. I'm speaking on both Bills 230758 and 230759 introduced by Jamie Gauthier. In regard to these bills, unfortunately I cannot make a stance as to whether or not I am for it or against it. The mission of the Land Bank is to return underutilized property to productive use through a unified, predictable, and transparent process, thereby to assist in revitalizing Stated Meeting 78 11/02/2023 neighborhoods, creating socially and economically diverse communities, and strengthening the City's tax base. But unfortunately as it stands for us in the Third District, we are in a situation where we may not be informed about what's coming to our area. We won't have a say. We won't have a voice in deciding what is put in our community. So as it stands in regards to over 500 supporters who are signing on and counting, as our elected Councilmember Jamie Gauthier has failed to inform her constituents by not allowing us to participate in those decision-making, we agree that by not consulting with the community before excluding us from the protections that other bills grant in all the other Philadelphia districts are included in, we insist that the Councilwoman that we elected take action and accountability towards correcting this injustice by doing whatever is necessary to ensure Stated Meeting 79 11/02/2023 Philadelphia's Third District residents are also safeguarded, and we retain our right to be included in how our district is governed. Instead, redirect funds for injection sites towards preventing the very traumas that cause the desperation that drive people to cope through drug abuse. Investing the preventative measures, such as improving the quality of schools, access to jobs, adequate housing, food security, and mental health resources, are just some of the needs that should be prioritized. We have spoken to Councilwoman repeatedly, many meetings, and as it stands, she still insists that we can't -- okay. I'm sorry.

-- that she won't address this until 2024. So I just want to let the Stated Meeting 80 11/02/2023 community know time is of the essence and we have to vote.

Good morning. My name is Catherine Blunt. I am a Stated Meeting 81 11/02/2023 resident, in fact a homeowner, of the Third Council District. I am a block captain, RCO member, and I am a member of the People 215 Coalition. I'm not sure of the intent in giving away these listed properties, because constituents do not have a voice in this process. However, I and those I represent do want a voice in determining the prospect of safe injection sites in West and Southwest Philadelphia. We are asking our Councilperson, Councilwoman Gauthier, to introduce on November 9, 2023 legislation that as tasked would add our Third Council District to the overlay now protecting nine Council districts but not ours. We want our voices heard on this matter, and we are asking fellow Councilmembers to co-sponsor, support, and expedite the passage of this new legislation we are strongly encouraging our Councilperson to introduce by Stated Meeting 82 11/02/2023 11/9/23. Good afternoon.

-- and Councilmembers and listening audience and those who make up Philadelphia County. I'm speaking today -- I'd like to applaud Councilwoman Brooks for introducing the resolution around YEAH Philly, Kendra and James who founded YEAH Philly, the group that creates space for teens. So many times so often our teens, particularly Black teens, are criminalized, but here's an opportunity for a market in West Stated Meeting 83 11/02/2023 Philadelphia to be run and operated by our teens, and I am so excited to see it up and running and serving the community. And I'm just so happy that this is an opportunity. Why can't we duplicate this around the City? And I just want people to think about how easy it is to criminalize our Black children. So many times so often people don't stand up and fight for them. Do they act out? Yes. But if you had to grow up in the City that's the largest most poverty stricken city in the nation that doesn't provide adequate housing, that puts you in the worst schools that are underfunded, and in my opinion intentional, and you have drugs around you, violence around you, and guns are readily made available to you but the things that you need to thrive are few and far between, how would you respond? Most of us have never had to grow up in the environment that our teens today have, especially coming from a Stated Meeting 84 11/02/2023 pandemic. So I applaud the leadership of Kendra Van de Water and James. I applaud Councilwoman Brooks for recognizing them, and my prayer is that people all over West Philadelphia will benefit from having healthy foods, vegetables, and meats so that they can fight off the many diseases that we see Black people lead in. Good morning. SOLICITOR CORTES: Council President Clarke and esteemed Councilmembers, I am Diana Cortes. I'm the City Solicitor. As you've noted, I've held this position since December 11th, 2020, and I will end my tenure on November 10th, 2023. I'm humbled, honored, and privileged to have served as City Solicitor of this great city. I want to thank you and recognize Councilmember Gauthier for putting forward the resolution and her great leadership and partnership in the great triumph we were able to get in the UC Townhomes. Her leadership on that issue was inspiring to me and my team, and I'm grateful to have been able to work with you on that. Thank you also to Councilmembers Jones and Thomas for your Stated Meeting 86 11/02/2023 great leadership on your respective matters that we worked on as well and your very kind words. They are also inspiring and have made my work here at the Solicitor's Office very meaningful. So just really quick, during my confirming hearing when asked about how the Law Department can provide equal counsel to the Administration and City Council given their differences, I compared it to a family. Our city government is a family whose collective goal is for Philadelphia to persevere, thrive, and I think for our sports teams to win all championships. Sometimes family members have different ideas on how to accomplish these goals, but those different ideas do not require separate legal counsel. I am proud to have worked with all of you as members of the City government family and to move forward toward these goals. And at least how it is in my family, every now and then family members Stated Meeting 87 11/02/2023 check each other, and it's how we respond and work with each other, because it's all coming from a good place. So I appreciate that from each and every one of you. On that same day during my confirmation hearing, I laid out the agenda with the Law Department, continuing and expanding DEI within the Law Department. Under my leadership, we were able to expand the Mansfield Certification where we are interviewing at least more than 50 percent of diverse applicants for every position, not just supervisory. We also ensure that at least one diverse individual is interviewing each and every candidate. We also make sure to use DEI competency questions in evaluating each and every candidate. This past two years we were able to put a DEI assessment in our performance evaluation. The other goal was implementing police reform. So we during my tenure Stated Meeting 88 11/02/2023 continued to work with the Philadelphia Police Department in the Bailey litigation, and in the last collective bargaining agreement, we advocated and fought for and obtained civilian involvement in the PPD disciplinary process. We were also able to get a separate arbitration board panel to hear terminations of officers, and at least 40 percent of that arbitration panel would be diverse. Last, and certainly not least, we worked side by side with esteemed Councilmembers Gilmore Richardson, Jones, and Thomas in enacting and successfully defending their respective police reform legislations. Another goal was to increase affirmative litigation to meet the goals of the City. True to our Philly nature, the Law Department worked side by side, not just picking a fight with the bully in the schoolyard but also getting the results. We worked with this Stated Meeting 89 11/02/2023 Administration, Council President Clarke, and others to file creative and aggressive lawsuits in public safety, public health, and environmental justice. In public safety, I think as Councilmember Jones noted earlier, we didn't just go after the state in the Crawford matter but we also filed the first lost and stolen firearms civil prosecution.

We also filed two additional lawsuits, one against ghost gun manufacturers and the other against ghost gun dealers, which are currently pending. And as noted earlier, we were able to collectively recoup over $200 million in abatement funds for the City to combat the opioid crisis. In environmental justice, we worked with Councilmember Squilla and Gilmore Richardson and several other environmental advocacy groups to sue the state in order for us to have the ability to enforce our own plastic bag ban. And Stated Meeting 90 11/02/2023 about one year ago, we filed a PFAS lawsuit on behalf of the City. I am pleased to report that I, along with my phenomenal team, some of which are here today, and I have Renee Garcia, Kristin Bray, Valerie Robinson and a few -- and Ms. Jackie Brown hiding behind over there. I cannot do any of this, I would not have been able to do any of this without their partnership and also the 330-plus members of the Law Department who are dedicated public servants, phenomenal attorneys, and phenomenal people. So they have taught me so much during my tenure. It is also truly extraordinary to stand before you today and share this with you all with my daughter, Sophia. She is my inspiration and reminder of why the work of the Law Department, the work of this great City Council, and the work of this city are so vital. I am forever grateful to each one of you for your faith, collaboration, Stated Meeting 91 11/02/2023 and sponsorship of me and my department during these past three years. Our work together has helped improve the future for Sophia and our children, and I am forever grateful. Thank you. )

Are we afternoon? Good afternoon, Council President, Mr. Decker, and Councilmembers. I'm Renee Garcia, Chair of Litigation at the Law Department, and I am closing out the Diana Cortes Show today. During her time at the Law Department, Diana has led with compassion and empathy and also strength and courage. When there's a difficult or urgent matter, she's the first one running out straight towards it. When Stated Meeting 92 11/02/2023 there's a victory, and you heard this, she gives credit where credit is due, right? It's all about her team. And when there's an issue, she's accountable for the Law Department, right? And that's why you respect her as a leader. What you didn't see was Diana encouraging all of us, and especially our new recruits, to bring our authentic selves to work every day in recognition of the job that a municipal lawyer has to write and enforce the laws, right? And that's where we worked with you, and as the reverend said, we strive for justice, not convenience. She knows that to get that job done right, we need a diverse workforce, and you heard everything that she has done in her tenure to get the right people in the right jobs. On the first day that our recruits start, she gives a talk, a little pep talk, and she says you are in the right place at the right time just as Stated Meeting 93 11/02/2023 you are and we will support you. And can you imagine, has anybody had a boss told them that on their first day? Can you imagine how powerful that is, right, that sense of belonging that she brings on day one? Because we know this job is hard, right? It is hard. It weighs on us, just as it weighs on you Councilmembers. On behalf of the Law Department, thank you for the resolution. I understand your position and I appreciate you coming down to state it. And I want to say that I'm committed to continuing to work with you all on this matter, as I have over the last several weeks, and I feel a sense of duty to figure this out in Council District 3. As we've been going through this, I learned that 19139 is one of the City's top five zip codes for overdose deaths. This is not something that I'm going to give up on, and I look forward to continuing to work with my constituents on a comprehensive strategy for addressing the overdose crisis. And I also just wanted to make a technical point, that there is no Council on November 9th per the request, but I feel complete certainty in saying that after November 9th, safe injection Stated Meeting 95 11/02/2023 sites will still be illegal federally, so there is time for us to have this conversation in a real way, and I just wanted to thank everybody for coming today. I'm speaking on the behalf of Bill 230575. That is the bill that Councilmember Curtis Jones is submitting, lines and grades. It's very important that we enforce the little laws, because little laws get broken and people feel they can get away with big crimes. The crime of the City of Philadelphia right now is running rampant is the people that are out here committing crimes on all of us, bus drivers, police officers, citizens of Philadelphia, and some Councilpeople. I feel as though we as citizens of this city deserve all hands on deck to straighten this matter out. And this matter is only being perpetrated through Stated Meeting 97 11/02/2023 a handful of people. We need forensics, we need law enforcement, and we need collectiveness of everyone in this body to work diligently with Council, with the Mayor so that we can have a first-class city and people feel safe to enjoy the luxury of this great city. I said three weeks ago I will put my time and my wallet to address this matter. I'm not going to have my great grand-kids afraid of gun play. So I would ask if we put our differences aside and move as one unit and let's get this job done, because we have the tools, and with Councilwoman Gauthier, she has put her pen to power by supporting a forensic lab in her district.

Hello. Good afternoon. My name is Maria Mendez. I was born and raised in South Philly and I'm a daughter of immigrant parents that come from Mexico. I hear this constant misconception that youth don't care, but maybe people just aren't listening to what it is that we need. So many traumatized youth in our city, we need more resources, we need emotional support. We are hurt. We are tired of neglect. I started doing community organizing when I was 16 and fell in love Stated Meeting 99 11/02/2023 with the idea that someone as small as me could make change externally but also internally. I was given hope, and hope is the seed that I hope to spread all over my city. I want to see more youth show up at polls on Election Day. I want to see more youth involved in community clean-ups and seeing them become leaders, but for this, we need our adults, our guiders to listen, to care, and to provide. What do I do? I bring healing to my community. Thank you to Councilmember Isaiah Thomas again for recognizing youth activism. Thank you. (Applause.)

Good afternoon, Council President Clarke and Councilmembers. My name is Cathy Scott and I am speaking in support of Councilwoman Brooks' resolution regarding YEAH Philly. I want to add my congratulations for the work that this group is doing. It is encouraging to see the City shifting to restorative justice and a focus on providing increased services to children and youth, such as restoring funding to Parks and Recreation and libraries. It is an obligation we have as a community to provide services to our residents, but we have to make these spaces safe, which requires supporting groups like YEAH Philly and providing funding for services to youth in the Stated Meeting 101 11/02/2023 evenings and hopefully seven days a week. I echo what Melissa Robins said, let's expand the YEAH Philly model citywide. It would do a wonderful job in helping our city and our youth. Thank you. (Applause.)

I am here in support of Kendra Brooks -- Councilwoman Kendra Brooks's resolution for YEAH Philly. Having grown up in Nicetown, the Nicetown neighborhood here in Stated Meeting 102 11/02/2023 Philadelphia, I am very proud of you and the work that you've done. YEAH Philly, Youth Empowerment for Advancement Hangout, that alone should give us something to look forward to. When I grew up in Nicetown, I had the Boys and Girls Club that we went to. I remember the PAL. We know that the devil's workshop is an idle mind. We have to have something to do for young people, and public safety is number one. And while we're at it, let's support these forensic labs. We have to have that. We need to make sure that we can get some scientific work done to solve some of these crimes, if we really want to. We see some of them get solved overnight. We see others that are still being solved and it's been years ago. And we all have been victims or have family members that have been victims. So I just ask and say again thank you for Councilwoman Brooks, what Stated Meeting 103 11/02/2023 you're doing, and thank all of you Councilmembers for what you continue to do. Thank you.
