Councilwoman Brown

Madam President.

Council President Verna

Yes. The Chair recognizes Councilwoman Brown.

Councilwoman Brown

We need to allow the Clerk to read the title of the bill, and then I'd like to speak on the bill, Madam President.

Chief Clerk

Bill No. 110633, entitled "An ordinance amending Chapter 10-300 of The Philadelphia Code, entitled 'Minors,' by amending Section 10-303, entitled 'Unlawful Conduct of Minors,' and Section 10-307, entitled 'Parental Responsibility for Minor Children,' to 10/27/11 - STATED - 2ND READING provide for earlier curfew hours for minors, to provide for different curfews hours for additional age groups among minors, and to provide for parental liability, establishment liability, and for penalties and enforcement, for violation of Chapter 10-300 or any expanded curfew under the Mayor's emergency powers."

Council President Verna

Thank you. The Chair recognizes Councilwoman Brown.

Councilwoman Brown

Yes, Madam President. The beauty of the world that we work in is that it gives everyone an opportunity to have their say, and we would be remiss not to acknowledge the remarks, many thoughtful concerns raised by those who spoke during the public comment period. So we need to say thank you to them. I also want to salute and say thank you to our Mayor's Chief of Staff, 10/27/11 - STATED - 2ND READING Everett Gillison, who did provide clarity on a number of provisions that are in the bill and a number of concerns that were raised at the very first hearing. So I am going to understand the clarity that has happened and the amendments that have been given as a result of concerns expressed by many. The bill no longer applies to one, two or three neighborhoods. The bill applies universally to all 60-plus neighborhoods around the City. That is in response to legitimate concerns raised by citizens who said why doesn't the curfew bill operate in my community as well. Questions have been raised around research data or not, and there are mixed reviews about that. In response by concerns raised by members of this Council, a sunset provision has been put in the bill, amended into the bill, that will require us, both the Administration and City Council, to 10/27/11 - STATED - 2ND READING report back the findings as a result of the curfew law once and if executed. And as Everett Gillison has already stipulated, this is not a bill to criminalize young people. Regretfully, we have too many parents who don't step up and do their job. And so when parents, who have so many other issues on their plate, not able to be where they could be with regards to their kids, government has to step in. Ten thousand persons have been picked up. Only 200 of those 10,000 have been issued citations. Concerns were raised that ten days is not enough time to give parents a chance to respond to anything, and so we amended the bill again to give parents at least 30 days' timing to respond to any notices they get from government. Other issues were raised by those who spoke during public testimony. So know that the Administration and my office is open to sitting and talking 10/27/11 - STATED - 2ND READING with youth advocates who care a lot about what we're about to take action on, and know that I'll be working with the Administration going forward to respond to those issues raised by the Youth Commission and youth advocates. In closing, I'll say as was stipulated during the hearing, there is no silver bullet for young people. It does not exist. It takes a comprehensive assessment, first of all, of what works for kids. And we need to say thank you to Councilmembers who met with me offline this morning to remind us of some of those things working for kids so that we can really look at them closely during the budget review process. So we're going to seize the moment during budget to re-stipulate this is what we want when it comes to preventive measures for young people. Many of us are paying close attention. It's a puzzle, Madam President, requested by the 10/27/11 - STATED - 2ND READING Administration for us to build a safer city, and we're going to be paying close attention. In fact, I will be asking for reports myself. I will go on the record to say I will ask for reports from Everett Gillison and the appropriate personnel to see how it's working on a month-by-month basis, so that we really don't have to wait for two years at the end of the sunset provision. Madam President, we appreciate the debate. It was a healthy debate. We leave this Council every single time more enlightened by something we're trying to do to grow a safer city. Thank you, Madam President.

Council President Verna

Thank you. This bill having been read on two different days, the question now is shall the bill pass finally. The Chief Clerk will please call the roll.

Are there speeches on the part of the majority? The Chair recognizes Councilman Jones.

Councilman Jones

Do we have another piece of business?

Councilman Kenney

Do we have another bill?

Council President Verna

Do we have another bill?

Councilman Kenney

There was 660. It was Airport bonds. I don't think we could do it by consent. We did that already? All right.

Council President Verna

What bill did you say?

Councilman Kenney

We thought it was 660. Because it was Airport revenue bonds, we didn't think we could do it by consent, but apparently we did, so I guess it's all right.

Council President Verna

That was on the Consent Agenda. The Chair recognizes Councilman Jones.

Councilman Jones

Thank you, Madam President. I rise this morning somberly and tell you that there's a person missing in the Chambers, and that of Council, but a strong advocate for public policy. His name was Robert Stuart. It's my sad task to tell you that he passed away last night.

Council President Verna

Oh, I'm sorry to hear that.

Councilman Jones

Too soon, too early, but he has made a difference in my life personally and many of the lives of members in this body. Rob Stuart was the founder of Evolve Strategies, and he died of a sudden heart attack last night, but he lived more than many of us ever get to do in three or four lifetimes. It was Rob Stuart who invited me on the part of the Academy of Natural Sciences to talk about issues of fracking. He invited me also to the State of New Jersey to find the first house that had zero carbon footprint with a combination of solar, geothermal and hydropower. lifetime work, lifetime work, as an environmentalist, activist. He wasn't just an environmentalist. He was green. Rob believed in limiting carbon footprints and increasing the sharing transportation, clean water. He is the only man alive that could get me to drink directly out of the Schuylkill River through a machine that he believed and vouched for. For him, being green wasn't just a fancy fad, but he believed it paid in the long run and would make us a better city. Funeral arrangements have not been made, but my heart, my heart goes out to him and his family and his two daughters that will be survived by him. Thank you, Madam President.

Council President Verna

Thank you. The Chair recognizes Councilman Kenney.

Councilman Kenney

Thank you, Madam President. I'd just like to announce that the Rules Committee which was scheduled to start at 1 o'clock will start at 1:30 to give the Councilmembers an opportunity to collect themselves after our recent session.

Council President Verna

Thank you. Would anyone else like to be recognized? (No response.)

Council President Verna

Seeing no one, the Chair recognizes Councilman Clarke for a motion to adjourn.

Councilman Clarke

Thank you, Madam President. Before I call for an adjournment, I too would like just briefly to say how much I will miss Rob. Actually, as we were conferring in the Caucus Room, I walked out of the Caucus Room today and I actually thought I saw him standing in the hallway. be truly missed. He left a lot of things in the midst. He was working on a green project over in Glenwood Avenue, my avenue. Representative Vanessa Brown called me this morning to inform me of the news this morning, and she was obviously distraught. He was working on something for her. He worked for a lot of things in the Logan Square neighborhood, as you know, and it leads me to believe that we must be even stronger to continue his good work. So I just want to say condolences to his family. Sarah is a strong woman, but any visit that she can get from us would be very helpful, I do believe. So I just want to say it's a sad day for us, but it makes us a little stronger in terms of doing what we need to do for the citizens of the City of Philadelphia. With that, Madam President, I move that Council stand adjourned until Thursday, November the 3rd, 2011, 10:00 a.m. (Duly seconded.)

Council President Verna
