Yeah, can you hear me?
Yes, I can.

Jason Myers, J-A-S-O-N, M as in Mary, Y-E-R-S.
You swear or affirm to tell the truth, the whole truth, and nothing but the truth.
This application is for use as a two-family household living in an existing structure.
The proposed use, two-family household living, is prohibited in the RSA 5 zoning district.
South Kensington Partners have sent a letter of support.
Our vice chair has a few questions for you, sir.
Good afternoon, sir.
Have you emailed in all the required documents and exhibits that's needed and required to proceed with this case five days in advance of this hearing?
Thank you, sir.
Please proceed and we can share your screen.
can you see it we see your documents why don't you start so let me know um well how would you
like to proceed i have the requested documentation at the top here the denial letter uh tax certificate
uh my rco letter support uh my deed and the latest uh zoning notice posted on my building
why don't you tell us what you want to do here and what you're trying to do what you're
and then show us the photos that you think are important.
Yeah, it's very easy.
My property is a duplex.
It's always been a duplex built in 1920.
It's zoned as a single family.
I'm just trying to correct it to its actual usage
so I can get a rental license processed.
I can show you this is the front unit.
This is the alley.
It's wood doors and alley that goes into the back unit.
Here's the back of the building.
And then I have a bunch of pictures of the interiors.
But they're separate units.
They have separate utilities, separate meters.
The only thing that's shared is the water, which I pay.
How long have you owned it?
Three years last August.
And it was a duplex when you took it over?
Yes, it's been a duplex.
I assume it was built as a duplex in 1920.
All the utilities are separated, right?
They are, yes, except for the water.
Tell me what happened when you went to the RCO.
Same kind of deal.
I showed them the pictures and they voted in favor of it.
I'm not changing the usage.
I'm not asking for variance.
I'm not asking for any changes to be made.
I just want it recorded as what it was built as so I can get a rental license.
Questions from the board?
I have no questions.
i have no questions questions or comments from our attorney i have a question okay it says here
that there were two yeses but there were 17 people at the meeting the meeting yeah i mean
was there some reason why so few even voted
maybe those two are the only people that were relevant to my neighborhood i can't answer that
um uh board member gaston it it does um it's hard to see in the letter but i do remember
seeing seeing this previously i however they determine their eligibility for voting
of the 17 people that were there only two were eligible to vote on the matter that's why
because of their proximity to the property probably yes i'm not sure what their policy
is in terms of votes but i know some of them will limit voting to people within the within a certain
area um in relation to the property okay i i you know just just for your purposes um mr myers i'm
just interested in that we send out a number of notices and then there's a smaller subset that
actually comes to a meeting and door you know that actually vote uh for proposals how many how many
How many notifications did you send out, Jason?
Oh, I don't remember the list.
It was like 150 or something like that.
I also spoke directly with all of my direct neighbors that I share properties with.
I spoke to all of them personally.
I told them about the hearing.
I requested their participation.
Whether or not they showed up, that was on them.
But I spoke to them in person and invited them to come to give their opinion.
Okay. Thank you.
Thank you.
um questions or comments from our attorney so bill i have one more question mr chair
yeah sure um and it's actually for hillary so hillary on atlas that shows that this property
was issued a zoning permit in 2011 for use of the two dwelling as part of opa um lot
consolidation and i'm just wondering like what caused the status to change if it was issued in
2011 so it may yes ellen i may have determined there was not a continuous use um so then it
reverted back to um the either the cart whatever if it's been i don't know if it's been single
family zoning forever but it um it reverted to whatever the current zoning was um so there
there there was no yeah there were there must have been some determination that there was not
a continuous use so okay and then my question for mr meyers you to the best of your knowledge know
if the previous owner was lived on site and only rented one unit and are you planning to
live on site and rent one or both of the units? I can't say for sure about the previous owner,
David Conte. I know he was living in New Jersey when I bought it from him. I was living in the
property. I got a new job. I moved to Texas. So that's why I went through the process of getting
a rental license so a property management company could effectively manage the property while I'm
living so far away. And that's why I ran into this part of that rental license application
says it has to be zoned properly so i looked up my zoning said it was single family
i know it's not so i started this process okay thank you your comments more attorney
not at this time mr chair question or comments from the virtual audience
i see no hands share planning commission
thank you chair bergman sorry one second mr chair we got a hand that was just raised at the
at the end there okay sure no they went back down okay thank you there any sorry oh now it's back
