Aye. The ayes are 17; the nays are zero. A majority of all members having voted in the affirmative, the bill passes. 12/6/07 - STATED - 2ND READING I would ask the Chief Clerk to please read the title of Bill No. 071005.

Chief Clerk

An ordinance amending Title 7 of The Philadelphia Code, entitled "Housing Code," by adding a new Chapter establishing inclusionary affordable housing requirements, all under certain terms and conditions.

Council President Verna

This bill having been read on two different days -- excuse me. Councilman Clarke, I believe you have an amendment on this bill.

Councilman Clarke

Yes, Madam President. I have an amendment on the inclusionary housing bill that spells out one issue. This amendment deals with the sale of the affordable unit by the initial purchaser. Upon the sale of that unit, a percentage of the appreciation of that sale will go back into the Affordable Housing Trust Fund. Essentially, the person gets a unit for a hundred thousand dollars. 12/6/07 - STATED - 2ND READING Because of its location, it could conceivably resell for a million dollars, and the thought was that a percentage of that resale value go back into the Housing Trust Fund to help replenish the fund so we can continue to do affordable housing. So I offer --

Council President Verna

Excuse me. Is that after a certain amount of years?

Councilman Clarke

Fifteen years, yeah. You have to stay in the unit, similar to the current OHCD regs, if you get an affordable unit, you have to stay in the house for a period of time, 15 years. So if that person sells that property, because of the whole nature of it, the fact that it's an affordable unit that's more likely built within a market-rate development, the likelihood that the value will increase dramatically is pretty high. So the advocates wanted to make sure that a percentage of that resale helps replenish 12/6/07 - STATED - 2ND READING the fund.

Council President Verna

Thank you.

Councilman Clarke

So I move for the adoption of the amendment to Bill No. 071005. (Duly seconded.)

Councilman Goode

Madam 12/6/07 - STATED - 2ND READING President?

Council President Verna

Yes, sir.

Councilman Clarke

Thank you, Councilman. I'm sorry, Madam President. Madam President, there was actually a technical amendment to that bill also. So I would like to offer -- that was just defining some language, but it's nothing about the substance of the bill. So if I could -- I thought they were both on one sheet. If I can offer the adoption.

Council President Verna

And that's regarding, for the stenographer, that's Bill No. 071005?

Councilman Clarke

I'll start over again. I move for the adoption of the second amendment to Bill No. 071005. (Duly seconded.)

Aye. The ayes are 17; the nays are zero. A majority of all members having voted in the affirmative, this bill passes. Councilwoman Brown, your light is on. Did you want to be recognized at 12/6/07 - STATED - 2ND READING this time?

Councilwoman Brown

Yes. I did want to ask for a moment of silence on behalf of John Skeef wherein our City will be celebrating his homegoing service this Saturday.

Council President Verna

All right.

Councilwoman Brown

Shall I comment now briefly?

Council President Verna

Please.

Councilwoman Brown

What we know is that 20 years ago he had the idea of celebrating Kwanzaa. Twenty years later, Kwanzaa is a citywide celebration. And we would be remiss not to acknowledge that he was one of the first pioneers with regards to charter schools. Twenty years ago he opened Arombay, and now 20 years later, we have 61 charter schools in the City of Philadelphia. It was his voice that led the march on why we need options when it comes to public homegoing service this Saturday. Thank you, Madam President.

Council President Verna

You're welcome. So with Councilwoman Brown's remarks, we would ask for a moment of silent prayer. (Moment of silence.)

Council President Verna

Thank you. Are there any speeches on the part of the minority? The Chair recognizes Councilman Kelly.

Councilman Kelly

Yes. Thank you, Madam President. Madam President, I know you and most of all of our colleagues in this Council, especially Councilman Jim Kenney, Councilman Greenlee and Councilman O'Neill, want to join me in congratulating Roman Catholic in defeating the Prep for the Catholic League Championship. you, Madam President. Councilwoman Tasco

Thank you, Madam President. I will be very brief. I'd just like for you and my colleagues to join in congratulating my staff member Wayne Terry, who has been with us a few months, who will receive his Bachelor of Arts Degree in Psychology tonight at the University of Pennsylvania.

Council President Verna

Wonderful. (Applause.)

Council President Verna
