stormwater requirements which we're dealing with right with the water revenue bureau uh water
department and you know god can speak of that the driveway proposed for access to parking lot and
trash pickup is too small and too close to the neighboring residential home there is a little
sliver to the right to our right which is property and we we you know we have a natural like
landscaping to do the buffer but we would be more than happy to make whatever reasonable changes
that that would be requested of us the homeowner at 1629 church lane feels the plans for the lock
cross across this property line well that's not the case right we have a survey the homeowner
next door will have limited access to the side of his house which that's on our property but you
know having a driveway would probably be better for him anyway because then he would have access
to the side of his property or our property or side of his property through our property
and we'll be forced to live with constant traffic noise gas fumes and garbage smells which is not
the case. We have a garbage room that's in our building. We have trash pickup three times a week
and all of our parking is 18 feet away from him. There are no plans to provide guardrails to
prevent cars or trash. I can't read this part. Trash trucks from slamming into the residential
homes next door. We do. We have natural landscaping, but we'd be more than happy to address that.
again we only had one community meeting and we were ignored but they had three community meetings
on top of that uh hazards and too small outdoor space the outdoor space proposed for 42 units is
too small it's 800 feet just where it is not including the area which will temporarily be
used three times a week for you know uh three point turns but obviously we can talk about that
but we never had a chance uh let's see the patio is hazardly placed along the covered parking lot
area with no protection indicated we put we have fencing around that and we would be more happy
We have fencing around that, and we would be more happy to have further discussions, except we haven't had further discussions.
to have further discussion
Trees. Neighbors advised the developer that trees were unwanted in areas that they could possibly fall onto the driveway or someone's home.
We did shrubbery, not trees.
But we also said, if you want us to have that more bare on that side, we'd be more than happy to do that.
The property elevation makes this problem even more threatening, yet 40 trees are proposed.
we're not proposing 40 trees on this 22 000 square foot site we're doing shrubbery around
the left and in the back the homeowners of the immediate surrounding blocks are already burdened
with two existing high-rise apartment buildings across the 1635 church lane on the other side
which don't have parking and which are not accessible i added that the addition of four
stories and 42 extra units is an excessive burden of saturation it's not it's a 22 000 square foot
lot, 21 parking spaces accessible, it's actually something that would be positive for the
neighborhood. Unnecessary consolidation. Neighbors prefer development of single-family housing on
three individual lots. It's 22,000 square feet combined. That's humongous. RSA 5 is 1,440 square
feet. These are long lots, not wide, but long. It just wouldn't be economically feasible under
the circumstances. Neighbors were open to discussing the feasibility of developing duplexes
for seniors similar to those existing on Church Lane or the 6,000 block of Lime Kiln Pike across
the street. Again, six units for 22,000 square feet. That's unrealistic and an unreasonable ask.
I don't even think it's the community because the community is being told certain things. We're not
being told certain things. Again, Mr. Nelson will say, it sounds like we disappeared. We didn't.
maintaining the neighborhood format would provide additional housing
while eliminate the needless burdens to so many neighboring residents
by the proposed four-story structure.
I don't know what they mean.
Anyway, I'll have Mr. Borovic be sworn in,
and I'll have a couple of questions for him.
So why don't you give me a sense of how much longer your presentation is?
That's it.
I mean, other than—
Are you calling Mr. Nelson as a—
Yeah, I mean, I think Mr. Nelson is going to speak on his own.
I just—I didn't expect him to be here.
I think it would be great for him to tell you.
You want to call him as a witness?
yeah i'm just saying i would just say we go here first all right sir could you please state and
spell your name for the stenographer yes alan boravich a-l-l-e-n-b like boy o-r-o-v like
victor i-c-h you swear affirm tell the truth told truth nothing but the truth i do um counsel yeah
alan you heard everything i had to state today have you heard everything i had to say is it true
and correct yes and do you adopt this your own testimony yes actually there was one thing i did
ignoring my presentation packet you did provide a one-page letter to you know to the zba that i
included in that packet why don't you um summarize what that letter is and why you put it in there
sent because of your frustration with this whole process oh hold on let's see it's a letter the
letter should be in here all right here we go yes this letter is from our development team and we've
reached out multiple, multiple times to the RCO. As Alan mentioned, we met with the RCO. We heard
their feedback. We made the changes that we understood. And then we wanted to, again, meet
with them. And we reached out, I mean, on when I tell you 20, 30 times, and we got zero responses,
and we got very conflicting stories. So we just want to make that known. And we're ready, willing,
and able and we're respectful neighbors and um but we were never given the chance okay all right um
lynn i see that you have a dell can i plug my no thank you sorry i just don't want my computer to
die um yeah so again and and you know you and and and and your associates which we have one here as
well like you've reached out multiple times to the uh city council member to explain that you you
you've been unable to schedule subsequent meetings with the coordinating rco is that right
correct um is there anything i missed uh that's that you know or different than what i said that
you want to explain to the board no all right thank you are you going to call mr do you yeah
i think we can call we can call you after i i think i think it's good to hear mr nelson speak
again not associated no i what thing is i still have another five cases okay so i'm trying to
target 1145 is the latest site with you okay that's fine we'll keep it short right yeah mr nelson
good morning sir could you sit close to the mic for me if you would
yeah could you please state and spell your name for the stenographer james nelson j-a-m-e-s-n-e-l
J-A-M-E-S-N-E-L-S-O-N.
Do you swear a firm
Do you swear or affirm to tell the truth, the whole truth, and nothing but the truth?
Mr. Nelson, are you a neighbor?
Please, now, call them so you can...
So, Mr. Nelson, we didn't ask you to come here today, right?
Absolutely not.
And we've met you on three separate occasions, right?
Yes, today being the third.
The first one was the community meeting.
Then we had this original hearing date in July, right?
And today.
And today.
and and each time we told you we're going to take care of that retaining wall yes okay now you told
us through our shock and amazement there were three other meetings besides the original meeting
that you're knowing that you know of about this project that i heard from miss sandra that there
was three other meetings because she indicated to me that i missed two and i was shocked because i
would have been at every one because i was opposing this situation okay and you know we
talked about you know your and your opposition's based on the retaining wall that's in the rear of
the property that i've been there since 1990 that i've always had an issue with that whole piece of
land but if we took care of the retaining wall you would have no opposition i wouldn't have a total i
would go with the neighbors and see what their gripes are because all of our disapproving issues
are all different mine is 100 retaining wall because the property butts up against me and
the neighbor at 16 that's right next door. So our homes are directly behind your property. So that's
what I was mainly coming at any time. If that wall wasn't fixed, that was my definite opposition.
And there was an indication in the letter of opposition from the ACCA group that one of the
issues was about light and air for your properties. But we're 50 feet set back from you. You wouldn't
have an issue with lighting there lighting in there wouldn't affect me it might affect 17th but
for me it's sitting reset so that part was not going to affect me yeah and during the fourth
meeting that you did attend you didn't attend the second the third there was an indication from the
community organizer that the group shouldn't mention parking because we're providing parking
and that's a positive thing and most most developments like this don't provide parking
right it was mentioned but she worded in a way that the zoning board does not care about your
parking issues this issue that issue we're like well we're not zoning so what can we gripe about
so that's where the water issue came up at one point the trash issue but again we weren't led
a hundred percent for what you're showing in these skits that i'm seeing i haven't seen it so i would
like to read these things and really take it back to the neighbors because some things we don't know
and some things they do but i'm not aware of the stuff that you're saying today like the retaining
wall 100 being taken off the plan i found that out today and that was through cindy bass's
office because i'm like what are y'all doing about this project and he said well they already took
the back wall off that's taken care of i'm like that wasn't mentioned on thursday's meeting so
So again, but we did mention, well, why is the retaining wall still an issue?
And I say, because the trees and the roots knocked the wall down.
And that's the issue I've been dealing with since 1990.
All right.
If you want to talk to, I mean, you're here separate and in part.
So if in narrative form, is there anything else that you want to tell the board?
No, I would definitely like to have us sit down with you guys again as a community.
So we're 100% on the same page for those that disapprove and don't know what's going on.
that we're a hundred percent on the same page and those that still oppose it we can say we oppose
it because of this but everybody has a different issue and adjacent to where the property is going
to be my main issue is that back wall and if it's taken care of i'm not going to say i still oppose
it but i want to see i want to go what the neighborhood is saying to say okay well i see
your point i don't want it to just be about me i want to make sure as a community we're all
talking about the same thing because parking wouldn't be an issue for me, but for some
it might, and that might be still a sticking point. But again, I think
you mentioned to me, she said it was a positive that we provided parking, right?
Yeah, that most apartment buildings in our neighborhood
wouldn't even provide parking, so that would have been a plus that there is
21 spots that would be off the books. But of course, we
said, but it's 42 units. That was our way of shifting.
yeah that's all all right thank you and one more Anthony and why don't you just come up
I mean you're done I mean if you're done I just want to make sure you've said what you needed to
in front of the board yes all right okay Anthony please state and spell your name for the stenographer
Anthony Fullard A-N-T-H-O-N-Y F-U-L-L-A-R-D do you swear affirm to tell the truth the whole truth
Do you swear a firm to tell the truth, the whole truth and nothing but the truth from counsel anything? You're part of the ownership team, right? Yes. Can you explain the efforts that you secondarily made to, to get, get the community input that we needed and the presentations?
and nothing but the truth confirm counsel Anthony
We should have had in front of the community. Sure. After the initial meeting that we had, and it was a lot of concerns from the community and they articulated that.
so we went back and we listed all of the concerns that they had expressed and we
addressed all of those concerns and then was ready to represent in front of the RCO and the
community again to show them that we hear you we are making those changes and you know you know
and and we just wanted it to continue that lines of communication before we uh you know was able to
come before the zoning board hearing which we had already expressed of what that time and date was
yeah and so you reached out to the council member's office stating that even our office
had meet approached multiple times for reasonable requests we didn't make all the changes like
making it until one story structure have only six units dedicated to senior housing but things
that we could change, we did, and we wanted to present to the community, and you reached
out to the council member's office?
I reached out to the councilwoman, I reached out to the chief of staff, and they themselves
numerous of times called, reached out to this RCO to request, I mean, you know, why aren't
you getting back? Why are you not responsive to the developer so that we can move this
process forward through the normal process of the policies and procedures that RCO operates
under? And where I know I must have spoken to the councilwoman at least about 10 times
about this. I know that she had called and reached out to them on numerous of occasions
as well as the chief of staff.
Ironically, something came out at some point in time
that the present RCO leader was no longer
was resigning from her position from that RCO.
So then we were waiting, okay, well, if that's the case,
then who do we reach out to, you know, excuse me,
so that we can get some kind of response.
uh and then uh we was uh soon after that told uh well you know she's not resigning now she's you
know she's still in but at some point in time she will so it's like really confusing okay well then
who do we communicate to who are we looking for the response from and the councilwoman's office
you know both chief of staff and also councilwoman cindy bass reached out to get those types of
clarifications from the rco and to this day you know as i sit before you right now
really have not had a clear uh understanding until what we know this letter came well fourth
what 4 a.m in the morning uh uh and that was our response yeah and again i think that's enough we
want you know obviously to hear from uh the community group i will say this we fleshed out
this project. This is a responsible project. We've made reasonable modifications, and we would ask
the board to vote on this project. I think, unfortunately, I think the community has been
poisoned by what's happened to date, and I don't even think we would get a fair forum, honestly,
because of what happened, you know, for the six months this has been in front of the community.
Thank you. All right, so let me say this. We have the board to ask questions, and that'll be a while.
You also have your architect available.
Yeah, of course.
And we don't know what's in the community.
So what I want to do is create a result of hearing.
I mean, I just don't want to rush this.
Like, I don't want to say, okay, the board's got to get done real quick.
I mean, everybody has some legitimate questions.
It's a nice big project.
