Chief Clerk

An ordinance amending Chapter 9-2900 of the Philadelphia Code, entitled "Takeout Sale of Malt and Brewed Beverages," by creating the Malt and Brewed Beverage Hearing Board and revising the fee and procedures for the request for City 5/31/07 STATED - SECOND-READING CALENDAR approval of a permit to sell malt or brewed benches for off-premises consumption, and amending Section 20-304 of the Philadelphia Code to provide for the compensation of the Hearing Board, all under certain terms and conditions.

Council President Verna

Thank you. The Chair recognizes Councilwoman Tasco.

Councilwoman Tasco

Thank you, Madam President. To those members of Council who were not in the caucus, I just want to say that these amendments were voted out of committee last week. However, through some miscommunication, they did not make the Clerk's Office. So, therefore, we are offering these same amendments that were approved in the committee meeting, and they have been circulated. (Motion seconded.) 5/31/07 STATED - SECOND-READING CALENDAR

Council President Verna

It has been moved and seconded that the amendment be adopted. All those in favor will say aye. Those opposed? The ayes have it, and the amendments -Councilwoman Blackwell?

Councilwoman Blackwell

Obviously, I agree with the amendments. My only question, and my staff even tells me they went through this. I'm sorry I didn't before. But the -- oh, dear, the pages aren't numbered, so it would be the third page at the top where the language added says, "Protests should also include information regarding the following, although failure to include any such information shall not result in rejection of the protest." Could we not say "shall not automatically result in rejection"? 5/31/07 STATED - SECOND-READING CALENDAR Because consideration of those things may want us to reject it. I don't -- I just legally don't want to question what the language saying "shall not result in rejection" will do. We may want to reject the protest. But I'll abide by the advice of the attorneys in the room.

Councilwoman Tasco

It wouldn't be automatic rejection. It doesn't mean that they wouldn't be rejected based on the argument provided by the community organization or the people protesting. We don't want the committee to just automatically reject them, but they can be rejected.

Councilwoman Blackwell

But here it doesn't say "automatically." This says "shall not result in rejection of the protests," so it could result in rejection of the protests. I only question if we could put the word "automatically" result. One word, 5/31/07 STATED - SECOND-READING CALENDAR "automatically." Could we do that?

Councilwoman Tasco

Let me check with my counsel.

Councilwoman Blackwell

Thank you. (Councilwoman Tasco and counsel confer off the record.)

Councilwoman Blackwell

Just one word before the world "result" between "not" and "result." Then we don't have to have any legal battles about it later with some stop-and-gos who may say the law says it shall not result in rejection.

Councilwoman Tasco

Can we just add the word "automatic"? We'll accept that.

Councilwoman Blackwell

Thank you.

Councilwoman Tasco

"Will not automatically result in rejection of the protest."

Councilwoman Blackwell

Thank you. 5/31/07 STATED - SECOND-READING CALENDAR Thank you, Madam President.

Council President Verna

Okay. I think we have to have another vote on the amendment. All those in favor of the adoption of the amendment, please say aye. Those opposed? The ayes have it, and the amendment is adopted. * * * 5/31/07 STATED - SPEECHES, ADJOURNMENT
