Bernadette Tanksley commenting on 170335. (Approaches podium.)
Hello. I am Bernadette Tanksley, a member of the OCA, the Oak Lane Community Action Association, registered community organization that serves East Oak Lane, which is situated on the northern Stated Meeting May 11, 2017 border between the City of -- the City and Cheltenham Township on the north, Godfrey Avenue on the south, Broad Street on the West and 5th Street on the east. I am here today to show you my support for Bill No. 170335 introduced by Councilwoman Cherelle Parker. Our RCO has been in existence since the RCO legislation was first implemented. The range of information provided to the RCO from the City and the applicant has varied from a statement of three lines or less that reflects little thought or preparation to full documentation and slide presentations. As the community attempts to review applications, it becomes clear that at the very least an informed recommendation requires significantly more than is currently required. The proposed form addresses an extensive array of highly relevant information. It alerts applicants to items that deserve consideration such as job creation, community impact and community benefit or Stated Meeting May 11, 2017 detriment. As proposed, the City would not require it for small scale projects. It is hard to understand why the City would choose to continue the RCO process without a mechanism for sharing this kind of information with the community reviewing the application. As indicated, the form would only be required for larger projects. It recognizes that some information may not be known at the time of the application. Meanwhile, the form would provide a major support to RCOs attempting to present appropriate information during the community review process. I want to thank Councilwoman Parker for her leadership and engagement in our community. You asked for feedback from RCOs while you were drafting the legislation, and we appreciate you for providing an opportunity for us to be heard. I also want to thank the bill sponsors Councilwoman Maria Sanchez and Blondell Reynolds Brown, Chairman Bill Greenlee and all members of Stated Meeting May 11, 2017 the Rules Committee for supporting this bill. I hope City Council will pass this bill and make it law. If you do it, it's a bold step towards making sure that all Philadelphians, regardless of their Zip code, have access to the information they need to build strong, sustainable communities. Thank you, Council President Clarke. (Applause.)
Joe Danihel commenting on 170449 and 170205. (Approaches podium.)
Morning. This is an official decree of the people and writ of mandamus quo warranto; and as such, requires immediate action remedy. This Council continues every week to authorize private property be given to RDA, Land Bank and other public agencies. The people are clearly designated beneficiaries of the Constitution, and government is by the people. Why has government refused to Stated Meeting May 11, 2017 investigate and provide immediate remedy, appearing to violate oath of office, Constitution rule of law? Violation of God given 42 USC 1982 property rights appears to violate Miranda B Arizona where rights secured by Constitution are involved, there can be no rule making or legislation which would obligate them. The Council and Mayor claim that when your God-given rights are violated, it's a matter for the courts. Have Council and Mayor forgotten their sworn oaths and their fiduciary duty. Cooper v. Aaron says you cannot violate the Constitution and laws without first violating your oath of office to uphold, obey and defend the constitution and laws. To Council, Mayor and the City opposed my seventh amendment common law trial by jury. Violating your sworn oath laws and constitution is non an option. The constitution requires immediate remedy of this breach of law. Your oath of office requires you to act or face prison. 42 USC Stated Meeting May 11, 2017 1982, 1983, 1985, 1986; 1918 USC 241, 242, 2381, 2384. PA Constitution Article I Section 1 through 11. 26 PA CSA 703, 705, 708, 709, 712, 713, 716 and other all listing SCOTUS 15-8965, 14-1330, 14-4056 appear violated. I call for the federal and commonwealth governments to perform their constitutional obligations to investigate and prosecute all involved in the theft and illegal deed transfer of my home 1038 West Wyoming Avenue, the denial of God-given 42 USC 1982 property rights for 23 years is egregious extraordinary oath violating and requires immediate remedy. A just government must obey the rule of law. The cover of all government must have it's charter government revoked until a constitutionally compliant government is installed. Public servants cannot refuse their sworn duty to act any more than a fireman can refuse to fight a fire. The sovereign people require the constitution laws be enforced. Jail is Stated Meeting May 11, 2017 required for all who would violate oath or law. It takes a lot of cooperation to create and allow monumental corruption. (Applause.)
Not here -there he is. He is here. (Approaches podium.)
Ma'ams. Two things. That I agree with the bill that's being passed today or voted on today with Wells Fargo, but also I think that we need to look at some of the other banks that are in this country that are good, honest banks. We don't need to perform -- and this is only my opinion, that we don't need to start a bank of Philadelphia because it's a lot of hassle and to get involved with that. And the other thing that -- my biggest thing today is that I know you put this on Stated Meeting May 11, 2017 next week's bill, but thank -- I want to thank the City Council and the Indigo bike people for the job well done. And thank you for keep funding that and making new bike lanes for the City bicycle riders. We appreciate that. And I'm urging that the bicycle people and the car people work together on the streets of Philadelphia because I have seen a couple accidents already since I started riding bikes. My six months going into being in the bicycle world. But -- and I've been in a couple myself because of cars being impatient -impatient with that. So, thank you. And thank you the gentleman and ladies from Indigo Bike Path watching this. Thank you for all your hard work and good job that you maintaining the bikes and keeping our bicycle world alive. Thank you, sirs.
There are no other Stated Meeting May 11, 2017 speakers in the Public Comment list, Mr. President.
Thank you very much. That concludes our Public Comment. We will now continue with our Calendar.
Yes. My name is Trine Smith. I want to say good afternoon to my fellow Philadelphians, President Clarke, City Councilmembers and the public. I am a social and environmental justice activist. And I urge you all to take bold calculated stance against injustice on all fronts. We understand that America can be a much better place if we would all just do that with fervent passion. I want to thank all earth protectors, those of air, land and Stated Meeting May 11, 2017 water and all who really fight for equality and justice. May we uncompromisingly in our search for truth -- may we be uncompromising in our search for truth. May we be relentless in our efforts to transform evil into justice. May we learn to imagine ourselves as healing, as thriving through the future and as creating new ways through the complexities of our times so that we are constantly reminded of our power and of our need to constantly evolve with life. Brightest blessings to all who will do. And may those contrary be damned. This is a testimony from Dr. Elizabeth Ellis in favor of Bills 1073300 [sic] and 10733900[sic] May 11, 2017. Since all Wall Street -- excuse me. Since all Wall Street banks engage in the same harmful and predatory practices, the only real remedy is to establish a public bank for the City of Philadelphia. The only ethical action for the City Council is to refuse to invest in either Citizens or Wells Fargo. We must protect Philadelphians from Stated Meeting May 11, 2017 predatory lending practices and exploiting management of our education funds, but we must also be accountable to native people and Americans most vulnerable -- in America's most vulnerable community across the nation. Liz went on to say as a citizen of Philadelphia as well as a citizen of the Peoria Tribe of Indians of Oklahoma, it is encouraging to hear that the plans to move our City money out of Wells Fargo, but city bank is not a solution. Both Citizens and Wells Fargo was among the top funders of Dakota Access Pipeline. The construction of the Dakota Access Pipeline is not only an environmental disastrous as it impacts drinking water of 18 million Americans, but it also clearly violates native sovereignty with funding from both Citizens and Wells Fargo, energy transfer partners violated federal treaties including the Fort Laramie Treaty of 1868, broke legal precedent as the Supreme Court guaranteed Indian nations water rights and that territories in 1908 Stated Meeting May 11, 2017 and circumvented federal regulatory procedures designed to protect Americans and all the environment that we all share. By investing in Wells Fargo and Citizens Philadelphia -- by investing in Wells Fargo and Citizens, Philadelphia taxpayers are thereby financing the violent and illegal assault on native bodies and territories and directly supporting regulatory capture in North Dakota. I urge you to follow and lead the City Councils of Seattle, St. Monica and neighbors in East Orange County, New Jersey to reject both of these banks. Thank you. (Applause.)
Thank you for your testimony, ma'am. That concludes our Public Comment for today. We will now -- Chair recognizes Councilman O'Neill.
