A resolution urging the Pennsylvania Public Utility Commission to take action to postpone the termination of electric and natural gas Discover Works Global 888.557.8650 www.dw-global.com 3/29/12 - STATED - 2ND READING utility service for customers who have pending applications for cash assistance under the Low Income Home Energy Assistance Program, introduced by Councilman Johnson.

Council President Clarke

The Chair recognizes Councilmember Johnson.

Councilman Johnson

Thank you, Mr. President. Mr. President, may I say a few words before I call for the adoption of the resolution?

Council President Clarke

Absolutely.

Councilman Johnson

Thank you, Mr. President. As of today, March 29th, the Pennsylvania Department of Public Welfare is experiencing a backlog of over 57,000 LIHEAP applications which have been pending for longer than 30 days. Over 35,000 of the backlog applicants are Philadelphians. The Pennsylvania Public Utility Discover Works Global 888.557.8650 www.dw-global.com 3/29/12 - STATED - 2ND READING Commission's winter moratorium, which prevents utilities from being terminated for low-income households for non-payment during the winter months, expires on April the 1st, 2012. Upon the expiration of the winter moratorium, utilities may terminate service to low-income customers who are behind on their utility bills. Thousands of low-income Philadelphians who are awaiting a decision for their LIHEAP applications could have their utilities shut off after April 1st. Therefore, I move for a vote on this resolution today because it is critical that the Pennsylvania Utility Commission step in and prevent utility shut-offs at least until households have received a decision on their LIHEAP application, and I ask for all my colleagues for an affirmative vote. I move for the adoption of the this resolution. (Duly seconded.)

Council President Clarke

Please do.

Councilwoman Tasco

First I'd like to thank my colleague Councilman Jones for those kind comments during his presentation earlier. I'd like to say that Philadelphia is a city of many, many firsts. One of the two important firsts was the unanimous decision by this Council in 2000 to pass legislation to protect our homeowners in Philadelphia from predatory lending. It fell on deaf ears. What we said is that it was very simple, just allow the potential buyer to get counseling prior to purchasing a home. It fell on deaf ears. But it sent a message throughout this country about the issue of predatory lending, and other cities have adopted the legislation we passed, but all of them are in court. The second is the Mortgage Foreclosure Diversion Program here in Discover Works Global 888.557.8650 www.dw-global.com 3/29/12 - STATED - 2ND READING Philadelphia. That program, set up by the First Judicial District and headed up by Judge Rizzo, it has received national acclaim, and many models have sprung up since that time. And certainly the National League of Cities has been a proponent of our diversion program. I want to thank John Dodds and the folks from the Philadelphia Unemployment Project program -(Applause.)

Councilwoman Tasco

-- for keeping this issue in the forefront, because we're still experiencing predatory lending. Back in 2000, we couldn't get the ear of the community because people were making too much money, but we see what happened as a result of that. It is not time to end the Mortgage Foreclosure Diversion Program. It is a national model, and I support the resolution and ask everyone to support it. Discover Works Global 888.557.8650 www.dw-global.com 3/29/12 - STATED - 2ND READING We know that still there are homeowners who are out there who feel ashamed because they might be threatened to lose their home, and we need them to come forth and know that the program is there. And my comments at the end would be, look, we need to assure them that help is available to them, and I'd like to say that if it ain't broke, don't fix it. And so I hope that -(Applause.)

Councilwoman Tasco

I hope that the leadership of the First Judicial District will hear and know that there's still people -- you know, this issue is not going to go away. As long as there are greedy folks in this country who are trying to make a dollar, they're going to always try and prey on innocent people. So we need to be there to protect them, and I think the court has done a great job and I ask them to continue the program. Discover Works Global 888.557.8650 www.dw-global.com 3/29/12 - STATED - 2ND READING Thank you very much.

Council President Clarke

There are no other resolutions on the Final Passage Calendar, Mr. President.

Council President Clarke

Thank you. Well, that actually concludes today's Calendar, but before we proceed, earlier today one of the presentations we had an individual who made it to 100 Discover Works Global 888.557.8650 www.dw-global.com like to say that I would hope that two of our colleagues, although they fall a bit short, whose birthdays are today, will make it to 100 years old. So today I'd like to congratulate Councilman Greenlee and I'm told also Councilman Green. (Applause.)

Council President Clarke

Now we know why people get you guys' names mixed, you were born on the same day. I want to thank you. Are there any speeches on the part of the minority? (No response.)

Council President Clarke

Any speeches on the part of the majority? Councilman Green.

Councilman Green

Thank you, Mr. President. I want to speak very briefly on the subject that I've discussed for the last two weeks, and, that is, the conflation or the combination of the Discover Works Global 888.557.8650 www.dw-global.com Value Initiative with the increased revenue of $94 million that the Administration is requesting. And I want to say that I consider them to be truly separate issues for the reasons that I've said for the last two weeks. But my concern after these hearings have begun on the Five Year Plan and other hearings we have undertaken is heightened, and my suspicions are growing about the situation we find ourselves in. The answers to simple basic questions that should be available to us as we contemplate this move are not available. We heard "I don't know" so many times that before a round of questioning began and I had a chance to ask a question and the Administration had a chance to answer the question, Councilman Squilla said, "I'll just answer for them, I don't know." That's what we've heard a lot, "I don't know." We appropriated a lot of money to OPA. A million eight has just been Discover Works Global 888.557.8650 www.dw-global.com to the City Solicitor for fighting the STEB challenges. The point here is, that million eight could have been spent over the course of the past year and the year before that in order to put us in a position where we have full information and we can make informed decisions. It seems to me that there was a purposeful delay in getting the necessary information so that it would be available for us as we contemplate this momentous shift, which must be done under state law. And I just want to say that I hope that's not the case. I look forward to continuing our questions of the Administration over the next few weeks and months, but I am very, very skeptical about the situation we find ourselves in, Mr. President. Thank you.

Council President Clarke

Thank you, Councilman. The Chair recognizes Discover Works Global 888.557.8650 www.dw-global.com

Councilman Johnson

Thank you, Mr. Speaker. Mr. Speaker, I just want to --

Councilwoman Tasco

Mr. President.

Councilman Johnson

Yes. Mr. President. I just want to acknowledge the hard work and -

Council President Clarke

I've been called worse.

Councilman Johnson

Yes, Mr. President. I want to take this time and acknowledge the passionate presentation by former Speaker of the House of Representatives, my former colleague in Harrisburg, but now my colleague here in City Council. And as I sat and listened to his passionate presentation about advocating and fighting for those most in need and particularly in this case, those who suffer from autism, and it's been his passion in Harrisburg as well as his Discover Works Global 888.557.8650 www.dw-global.com City of Philadelphia, and I just want to acknowledge. And although in this body the style may be different, but it was very statesmanlike and I understood where you were going and why you were doing your presentation in the context of how you did your presentation. I just want to commend you, tell you to keep up the good work. Thank you.

Council President Clarke

Thank you. Any other speeches? (No response.)

Council President Clarke

There being none, the Chair recognizes Councilwoman Brown for a motion.

Councilwoman Brown

Thank you, Mr. President. I move that City Council stand adjourned until Thursday, April 12th, 2012 at 10:00 a.m. (Duly seconded.)
